  • Filing for Parents - Please Help With My Questions if You Can.

    Hello everyone, I have a few questions regarding filing on behalf of my parents.


    1.) Can I file for my parents while I am still a Green Card holder? Or do I first have to be a citizen?

    2.) Does it matter that they overstayed their visas by 7 years? (They entered the US legally)

    3.) How long does this typically take?

    4.) Can they get citizenship through me or just Permanent Residence?

    5.) Does it matter that they aren't legally divorced, tho they have been separated for 10 years?

    6.) Will they be forgiven of working illegally in the US

    7.) If I sponsored them, would they have to get off of ALL government financial assistance? Would they have to also stop receiving government financial assistance for their children?

    Any other insight or information you have regarding this would be greatly appreciated!

      I don’t have answers for all of your questions but only some of them.
      you can file on behalf of your parents and your siblings only if you are a us citizen, they will get green card and then citizenship after 5 years if they stayed in USA for the required time.
      now the siblings wait around 14 years until the priority date becomes current for them.

      9/22 I-130 approved
      11/17 I-485 was reopened (never closed)
      11/18 I-765 approved
      12/22/20 I-485 approved

        1. You have to be a citizen
        2. As long they entered legally, you can. (Someone correct me, if I’m wrong)
        3. It’s pretty indeterminate right now, but I’d figure somewhere between 6-12 months.
        4. First they become permanent residents, then they can apply to be citizens after they have been residents long enough
        5. You will apply for them separately and include the marriage certificate to prove your fathers relationship to you. I don’t think them being separated will be a problem.
        6. Not sure, but I don’t think so. There might be back taxes to settle.
        7. Depends on the specifics. Please go through form I-944 and the public charge rule.
        8. You have to be a citizen for file for your siblings.
        USC filed AOS for parents on B2. I am not a lawyer.
