  • Laid off before AOS Interview EB

    Hello everyone! Unfortunately, my company decided to let me go today. I’m on the last steps of the adjustment of status I-485 (Employment based) and I'm expecting an interview at any point.
    I-140 approval 8/12/2019
    I-485 RFE Medical exam received 5/14/2020
    I know that in order to keep my application alive, the new role must be in a similar occupation to the old role on which I have the underlying I-140 petition.
    My question is, will USCIS reject my case if I attend the AOS interview without securing a new job?

    Ray-Hope Hello there, similar situation here..husband got laid off 2 months ago and expecting our I 485 interview soon. Hope someone will share their thoughts on this matter. Good luck to us.

      No experience whatsoever but I’m thinking if you can at least show you have been applying for jobs? Like bridge evidence of applications or emails with potential employers or whatnot. It’s uncharted territory with COVID and the state of the economy right now ... again, just an opinion

      6/18/20 - Case received at NBC
      7/6/20 - Receipt notice received
      7/13/20 - I-693 deficiency notice received
      8/17/20 - Biometrics appointment notice
      8/24/20 - Biometrics completed
      9/8/20 - Ready to be scheduled for an interview
      10/19/20 - Received interview notice for 11/18
      10/23/20 - EAD/AP approved
      10/29/20 - EAD/AP card received
      11/18/20 - Interview completed and case approved!
