  • Interview waived in marriage-based AOS?

    Hi everyone,

    I've been reading that some AOS interviews for employment-based cases have been waived due to Covid delays. Has anyone had an interview for a *marriage-based* case waived? If so, what do you believe contributed to this?

    Back in the day (years ago, that is), there were no interviews for employment-based cases, and interviews for marriage-based cases were not mandatory, but we know things changed after 2018. And i'm wondering how flexible they are now that the backlog is even worse with Covid.

    Very few data points but I saw 1 or 2 people on Reddit reporting waived interviews for marriage-based AOS (from B visa if I recall correctly).
    There was also 1 case in which the interview was waived, the card was approved and mailed, and then an interview schedule notice arrived some weeks later.
    Most employment based cases seem to be getting their interviews waived.
    Adjusting status from H-1B w/ immigration attorney.
    Forms: I-130/I-485

    07/23/2020 - Priority date
    08/06/2020 - Text msgs w/ conf numbers
    08/10/2020 - NOAs in the mail
    12/29/2020 - Bio appt dated 12/12 for 1/8
    01/08/2021 - Bio appt, status changed to fingerprints taken
    01/15/2021 - I-485 ready to schedule interview
    02/08/2021 - Interview was scheduled
    02/13/2021 - Interview notice for 03/18
    03/18/2021 - Interview complete
    03/19/2021 - New card is being produced
    03/22/2021 - Case was approved

      Thanks. It's good to know it's possible. I'm sure it's extremely unlikely, but if it's possible, it gives me some hope. I would think whether the interview gets waived would depend on factors such as 1) the strength of the case and evidence, 2) the discretion of the reviewing officer, 3) maybe the workload at the field office, but I hadn't thought that previous status would matter.. but we don't know.

        It was in the subreddit "USCIS", you can search in that sub only. I remember there was quite a bit of discussion about it.

          There is a case in October 2019 who got her interview waived after her interview was canceled due to covid

            My sister got her interview waived and received her green card two months ago. She and her husband have been married for over two years. I’m sure that weighed on the immigration decision. In my case, um still waiting for my interview to be scheduled since 2/25. My wife and I just completed one year of marriage.

                  Nice! In your sister's case, how long did the whole process take? Did they apply at the beginning of the marriage and had a long wait?
