Urgent Need help to understand forms I-485, I-765 and I-944

  • Urgent Need help to understand forms I-485, I-765 and I-944

    Hello ,

    I plan to send the application for the Green Card adjustment of status (concurrently) Married with a US citizen before the end of this month
    my questions concern the forms I-485, I-765 and I-944.

    Note that I arrived in the USA with a B2 Visa and my visa has expired so i'm on overstayed.

    here are the questions for the form I-485,
    First question:
    What is your current immigration status (if it has changed since your arrival)?
    so what i have to put there ??

    second question:
    INA section 245 (i)
    Are you applying for adjustment based on the immigration and Nationality Act (INA) section 245 (i)?
    what this questions mean can you explain me?
    do i have to check YES or NO? and they say if I check YES I also have to complete supplement A to the form I-485, Adjustment of Status Under Section 245 (i) (Supplement A)

    Third question:
    How many times have you been married (including annulled marriages and marriages to the same individual)?
    what i have to put ??
    Note that I am divorced and now marry a new woman.

    Fourth question:
    DECLARATION OF SELF-SUFFICIENCY (Form I-944)
    Are you exempt from the public charge ground of inadmissibility?
    i put NO but they said if i put NO, i have to fill Form I-944, but on the website of the USCIS there is no Form I-944, so what i have to do?


    In the Form I-765

    Eligibility Category, Refer to the Who May File Form I-765
    i put (c)(9), is it correct ??

    Second question
    first they asked for the immigration status at my last arrival, i put B2 Visitor.
    and after they asked : Your Current immigration Status or Category ( For example, B2 Visitor, F1 Student, parolee, deferred action, or no status or category)
    so what i have to put ??

    I really hope to receive answers to each question in order to help me better understand and complete the various forms.

    I think something like "B2 (expired)" or "B2 (out of status)" would be good.

    Answer No. INA 245(i) allows people who were beneficiaries of an immigrant petition filed before 2001 who are not otherwise eligible for AOS to file AOS. You do not have a petition filed before 2001, and you are already eligible for AOS anyway.

    This includes your current marriage. So if you have only been divorced once, it would be 2.

    You put No and do not include the I-944 for now.

    Also remember that you need to say Yes for I-485 Part 8 #17 since you overstayed. No explanation is necessary beyond simply stating when your status expired and that you stayed past that.

    Again, you can put something like "B2 (expired)" or "B2 (out of status)"
