Hello All -
I'm on L2 dependent visa and my spouse is on L1A. Their company has recently applied for GC under EB1 category. I140 is under progress. During last week as the dates has been moved, the lawyer has asked us to apply for I485/AOS processing. However, I am currently outside of United States and planned to come only on Oct 15th. As I have a Job back home, I'm not planning to move to US permanently until our GreenCard is approved or EAD for both of us is issued.
I need your advice!
1. Do I (L2 dependent) needs to be physically present when we (our Family) file for I485 or AOS?
2. If YES, How long do I need to stay in US after filing for I485 or AOS? Do I need to stay there until the process is completed or Is there a timeline?
3. In case, If I have to travel back from US to my home country, do I need to get any kind of documentation and get approval from USCIS, while the I485/AOS is in progress?
