Hello,
I'm currently on L1A visa, my company applied for my i-140 in the "EB1C" category in Oct 2019 and received an RFE in May 2020.
My company attorney confirmed that they will respond to the RFE which is "Ability to Pay the wage" by 11th October 2020.
Since the DATE FOR FILING in October 2020 visa bulletin is "01SEP20", my company attorney advised me that "i-485" should be filed by end of October.
1. Can I file i-485, when my i-140 is still pending? Or should I wait till my i-140 is approved?
2. Is it mandatory to file i-485 before 31st October 2020? Or can I apply in November 2020?
3. I'm in the 3rd year and the first extension of the L1A visa which is valid till January 2022, do I need to apply for L1A extension before the expiry date of my current visa or can I work on EAD with pending AOS?
4. Should I apply i-131, i-765 at the same time for both my wife and me? and usually what is the validity of this EAD and advance parole?
5. My L1A visa stamp expired, if I want to travel to India after my i-131/advance parole is approved, should I get a new L1A visa stamp in the US embassy or Advance parole is sufficient?
6. Should I wait till the "FINAL ACTION DATES" in the visa bulletin to be after my application date to apply for i-485?
Sorry for the long post, this is a very confusing process and I don't know anyone who is currently in my category to seek to advise.
