  • Self Filing - I485

    Employment Based EB2 category with date of filing current. Planning to Self File. My case is straight forward. Need help with some prelim questions. TIA

    1. Apart from I485 (AoS), I765 (EAD) and I131 (AP), I believe a to d are the ones I need to submit. Not sure if d and e are needed.
    a. Supplement J for 485
    b. I693 - Medical
    c. I864 - Adequate Financial Support
    d. I944 - Self Sufficiency
    e. Any other forms

    2. What is the correct filing fee?

    I am checking some sites that say there is no additional cost apart from 485 ($1,140 application fee + $85 for biometrics) if I765 and I131 are accompanying the application.

    But on the filing fee site https://www.uscis.gov/feecalculator, if I select all 3 forms, it comes to $1,720. Breakdown - Biometrics ($170), I485 ($1,140), I131 ($0), I765 ($410)
    - Biometrics is doubled.

    3. Do I actually need an employer letter OR recent pay stubs should work?

    Employment-based applicants do not need I-864 (you would check the box in I-485 Part 8 #62d).

    The filing fee is:
    * If I-485 is postmarked on October 1 or before: $1225 for I-485; no fee for I-765 and I-131
    * If I-485 is postmarked on October 2 or after: $1120 for I-485, $490 for I-765, and $585 for I-131, for a total of $2195

        Couple of other questions while filing I765 and I131

        Eligibility Criteria Says for (c) (35) - compelling reason. But for Spouse under (c) (36) does not show compelling reason. Confused whether I am applying through the right eligibility criteria. I am filing 765 along with 485 and not sure what a compelling reason could be here.

        For 131, does spouse qualify for this document? She is on H4 and does not have a A# yet. For spouse do we need to apply for I131 or they can travel without AP?

          You should be applying for I-485-based EAD, category (c)(9) for both of you.

          You guys both qualify for AP since you each have a I-485. It's also possible for someone with H1b or H4 status to leave the US while I-485 pending and not abandon I-485, even without AP, if they return to the US on the same type of H1b/H4 visa. But it doesn't hurt to have AP as an alternative. You never know when you might lose H1b/H4 status unexpectedly.

            Actually nevermind about the October 2; the fee change has just been temporarily blocked by an injunction.

              There is a A# on the I131 form and obviously spouse (derivative applicant) does not have one. In all other forms, the question states A# (if any). In I131, it does not say (if any). Wondering what should be listed here.

                Put "none" for her A number on all forms.

                  Do you know where I can get the correct and current fees for filing all three forms together? Some place I see we can file 765 and 131 without additional fee and on USCIS I see few for 765. What happens if I send incorrect amount (more than needed) to USCIS?

                        Experiencing an issue with I-485 application form for 2 fields. I need to fill in H1B for me and H4 for my spouse, however the form does not allow numeric to be entered. Any suggestions?

                          Need confirmation on question 61 in I485. I see the question "Are you exempt from Public Charge of Inadmissibility" a little bit confusing and intimidating based on all materials I read

                          I am on H1B and my spouse on H4. I was thinking the answer is "No" here.
