Me and my husband both are employed in the same company and we both have approved I-140 in EB2(my PD: Dec 2013, and my spouse’s PD: Dec 2014).
Can we both proceed with downgrade from Eb2 to Eb3 and list each other as dependent mutually? With this approach, both of us will have 2 I-485 applications (one as primary and other as derivative).
When one of the I-485 application is approved, we can withdraw the other application subsequently. This gives lot of flexibility to both of us in changing the jobs easily if needed (using AC-21). Also with this approach, we can do interfiling when EB2 moves faster than EB3, if needed.
Please advise if this is possible.
