@raghu_visa : Hi - I came across this forum and the list of suggestions you mentioned. Could you please let us know if the steps you listed out work for you. As in did you get a denial/RFE etc on GC? I am facing exactly same problem regarding DOB for my GC applicaton. Would really appreciate your answer

LakP412 The best person to answer your questions would be your attorney. and will you get a denial/RFE or approval is anybody's guess. I personally know someone who got his GC approved even with wrong DOB in passport but still in process of getting passport updated.
For me, I wanted to go through the same route to save time but My attorney had clearly mentioned that we need to change the DOB in passport soon even if we file the GC application with existing (wrong) details coz they don't match with birth certificate. And if the RFE comes and we don't have the updated passport, your GC application would be denied. Of course, attorney was playing on safe + legal side, I saw merit in doing it before then after. So I would suggest to follow your attorney and start the process sooner than later, I spent 2 months trying for 'alternative' Birth certificate but those are increasing difficult to come by now. Best of luck

I have the same problem and I need to file in this month only. My office attorney is not helping at all with clear instructions on what should I do. Should I use my DOB as in BC in 485 and start the process to update passport DOB ? Or should I use the wrong DOB as in passport and wait for RFE issued as it does not match with BC ? In that RFE what would me response ? Updated passport or just explanation ?

Unfortunately the only way I know of is to alter the date of birth in all your other records to match your original date of birth. It might take some time but can be done. You should be able to find many posts here where people talk about how they have gone about making these changes.

I would avoid submitting it as is and waiting for a RFE.

My attorney advised me to change DOB in my passport to match with BC. It took me a while to change it. I have detailed my steps in previous posts in this thread which you can refer. Feel free to message me if you need further questions.
I think it may take about 2-3 months to get that corrected from the Consulate.

Hi.. Is your application at SF Consulate or with VFS?
There is a questionnaire you will receive from Consulate which you needs to fill out. Unfortunately, this was not covered in List of documents in VFS.

This is a tricky position and you need to contact Consulate through email/phone to get some one online to get this Questionnaire. Feel free to message me. I can help you with the steps.

rln8316 Thanks a lot for your response. Actually I am following your steps. Corrected birth certificate by adding my name and received the birth certificate from Municipality. I also wrote email to consulate (all available emails) and I got response from Vice Consul (SFO) last week with questionnaire. As per his email instruction, I did complete the questionnaire and sent with my self-attested birth certificate. But no response after that. Its been more than a week. Is this normal or I need to keep write/call the consulate? Do you remember how long did the take to approve for your case? I am ready with VFS documents and waiting for his email approval to send my application.

Last year, It took me about 3-4 months to get the passport back with corrected DOB. Back then, it they were processing slow due to pandemic.
I recently spoke with another person who was undergoing the same DOB change and it took about same time for him to get the passport back.
