rln8316 I haven't tried any other option yet as I got my I140 approved in 2019 so long way to go. Do let me know if you were able to get your passport corrected to correct dob.

Did you able to get your passport updated? - I had to change the DOB per Birth certificate in my passport. You have to do apply for a fresh passport (change in the personal details). Unfortunately, you cannot do tatkal for this.
Also, did they perform police verification in India?- I dont think so.
Also What was the total time taken to correct the passport? - It took approx. 2 months. VFS processing takes quite a bit of time. You have to get an approval from Passport Counselor for this change. This was not mentioned in their instructions booklet. So i had to run pole to post to enquire about this. I infact tweeted Indian consulate to get hold of someone who can provide such details. These process delayed a bit.

Yes, i got that corrected.. i guess that is the path i have taken. so not sure how this journey will lead to.

I am also from Kerala and have the same issue. The attempt to get NABC failed as they were able to find my Birth Certificate with the original date. Could you please let me know the process of getting the approval from the Passport Counselor to request for a new passport? I was looking at the instructions in the website and didn't find the instructions anywhere.
Did your BC had all the details correct - like your name and parent's name etc? If not, can you pls let me know what's the process you followed to get it corrected?

sdds0522 --I could see this information on the VFS Global site--"A court order issued by a judicial officer, not below the rank of 1st Class Magistrate in India OR a Competent Authority (issues an amendment or correction in the date/place of birth of the applicant. The Competent Authority issuing the amending order should be the same authority whose certification was submitted at the time of the issue of the original passport. The Competent Authority in such cases can be Municipal Authorities (for date/place of birth and Educational Board Authority (for date of birth). Birth Certificate issued by Government/Municipal authorities."
I am not sure whether we need to change the 10th (SSLC) Certificate prior to the submission of the Passport change? If yes,then its a huge complicated process...i waiting for the response from rln8316
To get all the details of the BC correct--You have to submit an application to the Registrar office(at your birth location) and they will change it ---Recently govt issued a Order for allowing the changes on all the details like adding name/spelling correction but DOB.I added the name and did corrections couple of months back...Note: Due to Covid-19,Govt offices will be taking more time than the normal time, you can expect at-least 1 to 2 week delay.Some of friends told that we can do the change via Online...https://cr.lsgkerala.gov.in/...You can try that too..

1) You will get a letter from your Municipality that they have found your Birth Record
2) Apply for your Birth Certificate by paying some nominal fees/fine (i guess around rs.250.00) to get your name included in Birth certificate.
3) I guess it takes around 24 hours to update. Once you have your name registered, download from their website
4) Apply for new passport. You would need to check off- "Change in Personal details" --> Change of Date of Birth
5) Submit all the details + new birth certificate..
6) VFS website did not update the detail that you should get an approval from Passport Counselor at your Consulate. This is where I had to call in all the available numbers in Embassy's website. I also Tweeted SFO consulate to get some response.
7) Counselor will email you a Questionnaire for the discrepancy which is by now you will well versed to answer
8) He will approve...
9) It is easily a 1-2 months process to get this done. I think this will be a quite a long road to go. Maybe you can worth trying with what you have and you may get away without RFE.

I tried to change it in BC but i could not succeed it. However i got a letter (digitized form) with Govt of Kerala embedded from village officer which says "one and the same" certificate. I have included that with my I485 in case if that creates any issue. For USCIS.. as long as it comes from a govt agency should be good and they are not going to verify the hierarchy of Village officer and Birth Registrar.

kiranjosephklm - I have no idea to change my 10th in future. Maybe i will try to change my PAN/ Aadhar if needed.
have a question....For changing the DOB in the passport,whether original birth certificate document will work or do we need to change the education documents with new DOB prior to submission of passport change. ?
Original or the PDF digitized form will work. No need to change Education documents.Last edited by rln8316; 06-12-2021, 09:17 PM.

I am planning to check with attorney whether there is any option to not have NABC or Birth Certificate. Seeing most of the cases online and among my friends / colleagues, I think there might not be an option. Want to avoid RFEs as much as possible.
Can you please let me also know the order you'd followed to update the DOB in H1B, SSN, DL, Bank/Utility accounts etc? Do we need to file h1 amendment once the Passport is updated or it can be taken care during the next extension?

After DOB change below information i received from the attorney.
I believe once the DOB is changed, need to inform attorney...I believe they will inform to USICS.
SSN using passport-->DL using SSN/Passport .
(Bank/Utility accounts are private)....no much worries...
H1B amendment is not required...When u apply for DS160(visa stamping) use new DOB..

I have a question regarding the SSN update. Can it be done with the new passport only? In some other threads I saw the I797 is also required for it. Did your attorney provide any information on that?
