Thanks for sharing the timelines. Did you downgrade to EB3? If yes, when did you get the I140 approved?

    • We didn’t downgrade at all. I140 approval was long ago probably in 2010 I guess.

I don't know what your service center is but I would think that for most service centers the EAD processing time is around 9 months. I would recommend that you submit an “outside normal processing time” service request online with USCIS for your I-765 application.

That is pretty amazing that the Boston field office turned this around for you in one day after receiving your medicals. And Congratulations!

I see you were able to submit the medicals in a week after receiving notice. Did you do your medicals then or you had your medicals already done and ready to be submitted?

If you already had done your medicals, was it done within 60 days from the date you submitted it to USCIS?

I'm asking to know if I can get my medicals done at my convenience and submit it when I get the RFE (as long as it is within 2 years of completing medicals)

                Your inputs would be helpful.

                Congrats again.

Actually in our case, our attorney asked us to wait until uscis issues RFE for medical. So we waited until our attorney called us to proceed with medicals. As per our attorney, uscis were working hard to issue as many GCs they could before the end of fiscal year. So they didn’t have time to issue RFE at all. So our medicals were requested through the call to attorney from uscis. We never received RFE letter for medical. We tried our best to get everything done within a week. Luckily things came on our way together towards the success.
I would suggest to get medicals while you can as it has a validity upto two years. We felt that we could have done it earlier. Consult with your attorney as well.

My attorney is asking me to wait but the appointments for USCIS doctors near where I'm is usually difficult to find so it would be very difficult to turn around the medicals in such short time as you were able to. I would prefer to do the medicals sooner but looks like it must be submitted to USCIS within 60 days of completing the medicals. Else it becomes invalid.

A common misconception, the 60 days is before submitting the I-485. The doctor can't sign the I-693 more than 60 days before the I-485 is received by USCIS.

Recently someone in the forum sent the sealed envelope that they had for months and the GC was approved soon after USCIS received that sealed envelope with the RFE.

There is a small chance that an officer reviewing the documents will say "the signature is more than 60 days old and the form is not valid", but really is a very small chance.

My case is like yours with EB3 downgrade with PD Dec 2013. Trying to expedite my I-140 EB3 downgrade but got rejected recently.
But our EAD and AP got approved. I reached out to my congressman's office and they helped us expedite it and got approved in a week after expedite request accepted. You can try reaching out to your congressman.
