Each case is different, it can take few days, few weeks, or few months. In our case, it was 5 months.
Nov 2018 - Package sent - EB - Texas Service Center
Day 1 - Package received at the lockbox

      • Hi,

My AOS application was submitted along with my EB3 Downgrade I-140 on Nov 5th 2020 to the Nebraska service center.

My EB-3 I-140 Downgrade was approved on OCT 12th 2021. Biometric completed on SEP 13th 2021.

Priority date is JUNE 2014. There is no update on my I-131 (AP Application) to the current date.

I am planning for international travel once the travel restrictions are lifted in Nov 2021.

what options do I have and what is the chance of my I485 getting approved in the near term.

I am planning to approach my lawyer for recommendations.

On the same boat here with Atlanta office
10 Sep 2021 - the date when mail with medical RFE was printed
19 Sep 2021 - the date when I actually got it in my mailbox
22 Sep 2021 - the date when RFE was send by me to USCIS
24 Sep 2021 - the date when my package was delivered to Atlanta's USCIS office

No news since then, but I looked on different forums, at least for Atlanta it seems to be taking from 1 week to 5 weeks before they open up the envelopes.

So, generally speaking, if you have a pending Form I-485 and you leave the United States without an AP document, then you are considered to have ABANDONED your AOS application. BUT, AOS applicants who are in valid H-1B status, can travel abroad and re-enter the US in H-1B status while an I-485 is pending, without having to obtain AP, provided you have a valid H-1B stamp in your passport and are returning to the previously approved employer. So then, What is your current immigration visa status? Are you on H-1B and have a valid H-1B stamp in your passport? On what status do you plan to re-enter the US? If you have a valid H-1B stamp in your passport and plan to re-enter the US on your H-1B status stamp and status, then I believe it would be okay for you to travel internationally even though your AP is not yet approved. Definitely approach your lawyer for recommendations.

My H-1B stamp is valid till 2023. I am not planning to shift out of my H1-B status till I have green card and even my lawyer is not recommending.

Any idea if my I-485 application will be approved in near future or can I approach USCIS to approve my case sooner?

Okay. Technically speaking, as long as you have a valid H-1B stamp in your passport and you plan to travel and re-enter and be admitted back into the US on your valid H-1B stamp, then I think it would be okay for you to travel internationally even though your AP is not yet approved. Any immigration attorney worth their salt will advise you to err on the side of caution and will advise you not to travel internationally when you have any pending applications with the USCIS because when you travel internationally and try to re-enter the US there is always a greater risk of inadmissibility involved when you have any pending applications with USCIS. So definitely consult with your lawyer as well on this issue and follow their advise.

Did you also submit a EAD (I-765) in November 2020 along with your AP? The Nebraska Service Center is currently processing December 2020 applications. If you haven't received a decision on your EAD application yet then you are "outside normal processing time". You can submit an “outside normal processing time” service request online with USCIS to find out what seems to be causing the delay in adjudicating your EAD and AP.

As far as your I-485 application approval is concerned, may I ask what is your field office? Did you submit Medicals (I-693) along with your initial AOS filing or are your expecting a Medical RFE from USCIS? I'm inclined to say that your AOS should be approved in the near future but it would depend on your field office and whether Medicals have been submitted or not.

Yes My I765 and I-131 are submitted along with AOS packet (I-485) on nov 2020. I did raise a query on my I-765 on July 3rd Week and got a response on SEP 30th stating my case is in line to be reviewed by an officer.

Now this week I submitted a query for my I-131.

Reg my I-485, I did not submit my Medicals (I-693). When I enquired about it, my lawyer was against submitting it without RFE or courtesy notice as it can lay orphan on USCIS without any of these two.

The Nebraska Service Center currently seems to be processing employment-based AOS applications from April 2020. So it will be a few more months before they get to yours. My experience has been that when you receive the I-485-J receipt notice then that is a good indicator that the Officer is actively reviewing your AOS application. Since you haven't filed your medicals yet, the second major indicator that your case is closed to being approved is when you receive the Medical RFE. When you receive that RFE and the RFE is only asking you to submit Medicals (I-693) then that means that your case is ready to be approved and they only just need your medicals and everything else is good to go. So look out for these two milestones ... the I-485-J receipt notice and I-693 Medical RFE. These milestones will help with answering your question on when your AOS will finally get approved.

I don't understand it when you say Nebraska is processing EB 485 cases from April 2020. Everyone I know of who filed for AOS in Oct 2020 already got their GC. So even while a few cases from before Oct 2020 might still be pending, Would you have any reason as to why you say Apr 2020? Is it based on processing times in USCIS website?

To clarify what I really meant to say is the processing times for Nebraska SC on the USCIS website has "Receipt date for a case inquiry" listed as April 2020. Do you understand it now?

I am in EB1C category. The timeline of our application is as follows-
Oct 30, 2020: Application delivered at USCIS
                          March 2021: EAD Received
Sept 17 2021: RFE for medicals received
                          Sept 29, 2021: Medicals response submitted/ delivered
Our RFE letter stated that if we we submit our response before september 30, it would be considered for 2021 fiscal year allotment. Is that still true? I have not received any response after submitting.

Any idea how long we will have to wait for our GC ?

                          Regards,

                          • Hi,

M PD is Aug 2013 - Previously My case was filed in EB3 and then moved to EB2 Category and then again Downgraded to EB3 last year Oct 2020. So I have I140's approved in both cases.
The timeline of my application is as follows-

                            I-485, I-765, I-131 Applications received by USCIS on: 10/30/2020
Receipt Notice Date for all three applications: 01/21/2021
                            Fingerprinting Completed on Date: 4/02/2021
                            RFE for medicals received: 07/05/2021
                            Medicals response submitted/ delivered: 07/21/2021
EAD and AP Approval Date: 09/2021
                            EAD card received: 09/29/2021

I do not see any response or update on my case after that. My date became current in Sept 2021. I have contacted USCIS customer service and came to know that, Medicals are still not attached to my case and they are sitting in mail room in Philadelphia local office.
My attorney had created a service request on Sept 20 2021 and we are still waiting for the response from USCIS.

Since dates got retrogressed, will USCIS still be able to process my case as everything submitted already?

                            Any help/suggestion would be appriciated.

                            Thanks in Advance!
