Strangely I got appointment notices in mail after 5 days.
I think they change their responses and they are not consistent. For me they said the appointment has been scheduled but they cannot see the date and I got the letter within 2 days. May be it varies by location too.

The only reason that attorneys give for being on the non-immigrant visa is if the underlying GC gets rejected, so that one can dispute or refile or something; but its also a way for them to mint money coz EAD renewal doesn't require attorney's help and can be done on own. I have friends who had been working on EAD for the past 10 years or so without issues. Is it 100% safe - no; but good enough.

Also switching jobs with EAD is very straight forward where only a I485 J form needs to be filed with underlying conditions met like similar job and title etc.

Again everyone situation is different and you need to weigh in the pro's and cons.

Technically yes, it would be possible to work with EAD but I would think it can get quite stressful if the underlying green card gets rejected for any reason and the non immigrant visa is also expired. But yes, its case by case and everyone's circumstances are different so its a personal choice. It is good to know that AOS based EAD does not render you jobless if renewal is filed on time.

Curious to know how someone was on EAD for 10 years as it shouldn't take 10 years for GC to be processed. Are there any other categories where EAD can be obtained by the primary applicant without AOS filing.

Also, do you know of people who changed jobs with I485J easily. I guess my question is when that form is filed do we need to wait for its approval before changing the job or send the form to USCIS and can start working at a new place. Also, does it go against us when at the final GC approval because the underlying I-140 was filed by a different employer so the officer reviewing the petition could ask why you changed job etc etc

      • My I-485 application was received at Dallas Lockbox on Oct 30 2020. I haven't received any receipt notice yet. Is there anyone who is experiencing this. Its close to 5 months now.

Call USCIS. When prompted, tell them that receipt notice not received. It should transfer you to an agent, though waiting time might be long. If you have an A-number, agent should be able to help you out. That is from my own experience. Don't know how it works if you do not have an A-number.

          • Hi,

I gave my biometrics for L2 visa extension some days back. However, we have also applied for GC and submitted our documents on Oct 30th. All the people in my family except me had their biometrics done yesterday for GC. However, I have not received my notice yet.
I spoke to Emma, she said nothing has been scheduled yet. My question is - Can they use the biometrics I gave for L2 one month back for GC as well? Should I wait for another biometric appointment? Is there someone who has expedited their case, I am worried because I cannot work beyond April 9 with this current EAD. Any inputs would be great! Thanks

My wife is on a similar boat with respect to the timelines for EAD expiration, and we are still waiting for the new EAD. So things are on the line in here.

Regarding biometrics, I have read in blog posts for the fingerprints being reused by USCIS across different application types eg: H4 vs 485 etc. So considering your case, its a possibility that it may be reused since the rest of your family has received an appointment. All the best.

I believe he is in EB2 row and the filling date got current but the final action did not. For ex: someone in EB3 row India now and have a PD of late 2014, would be able to file the application for 485 now, get an EAD, but the final action date is still 2010. So I believe he was caught up in that scenario.

For the 485j filling, my understanding is that you can file the form after the fact. The link below gives a good summary on that. In summary, what I know is switching job in EAD is way lot easier than on non-immigrant petition.

                • Hi Everyone...i know it is almost impossible to predict. nevertheless, I am asking for an opinion. For EB1 October filers...when can we expect an interview as long as dates are current. Thanks.

y gut is: if all biometric are not done for october filer by end of april, then possible interview dates can stretch to Q1'22 -Q2'22

I am reading in blogs and hearing from attorney that USCIS is waiving a lot of the interviews for the employment based category. Another reason to believe the same coz USCIS is raising the RFE's to send the medicals instead to bring them at the interview. So its possible we might not have any interviews. Although in my opinion having an interview is better, coz then we know that soon after the interview the GC will be approved since the dates are current for EB1. Without it, its a hunch right now and we know what pile our files are sitting on.

I also believe that interviews need to be scheduled before 30th Sept 2020, so that it gets counted in the no of green cards for the fiscal year, otherwise it will be counted in 2022. But you never know. Lot of factors like priority date, field office etc. So you never know. I am in the same boat keeping my hopes.

I would guess a minimum of 3 months after biometrics before anything moves. Family based applications are getting interview calls. So assuming Biometric is after 1-2 months of filing, I will hope that movement for Oct filers will probably start in the late April - May timeframe. Again it's probably more hope and less guess though fairly confident that bulk movement will happen post July.

                              • Anyone with oakland ASC who received biometric appointment for filing date around October 29 or 30? Mine is Oct 29 and today USCIS support staff over phone confirmed that it would be Oakland ASC for my appointment. However, they could not see if an appointment has been made yet and advised me to wait to get notice. Anyone in a similar situation?
