October 2020 I1485 filers may join

  • Today when we chat with live agent through EMMA, we got the following response:

    Thank you for your patience. In regards to your case, it is still within the normal processing time. You can get an idea of how long it will take to process your case from the processing timetable available on our website at egov.uscis.gov/processing-times. If your case is not processed during the processing times listed, please go to our website and file an electronic inquiry to notify USCIS that your case is outside normal processing time. This option is available 2 4 hours a day. If this option does not meet your needs, you may call the USCIS Contact Center and speak with a representative during business hours. For the I - 4 8 5 the case was received on 1 0 / 2 6 / 2 0 2 0 and cases are currently being worked on from 0 1 / 1 5 / 2 0 1 7. This application is one of the longer applications and will take some time to process. The I- 7 6 5 has about 5 months left and the I - 1 3 1 is technically outside of the processing times, but since you applied for a combo card, you would need to wait for the processing of the 7 6 5 as well since the card cannot be produced without the other component also finishing.

    Very depressing and frustrating!

    • Hi Folks...I know we are all nervous and specially those who are waiting for Biometrics. Just to share this with you. My colleague and I...both (EB1B from same institution) sent applications on Oct 27 (me) and Oct 29 (her). I got my biometrics and EAD in February., while she has not even got biometric notice. So, I think there is no pattern at all since our circumstances are the same. Only with 2 days difference.

        there have been at least 10-12 green cards approved for October 2020 filers either they sent medicals which definitely helps or they got RFE for it. But all of those had biometrics done in Dec or Jan so I'm sure there's a pattern that it takes a few months after biometrics for USCIS to proceed further.
        My biometrics were done on Jan 7 but nothing after that so far. I didn't send medicals so I'm hoping for the RFE now. Getting the RFE almost certainly means that interview is waived.

        Having said all of that, USCIS is so unpredictable that your green card may be approved next month since you have already sent medicals and there would be no logic behind his they prioritized it.
        I will keep you all posted once I get next update. One thing though, Emma told me today that "You are currently waiting to be notified if you need to come in for an interview. You can get an idea of how long it will take to process your case from the processing time table available on our website at egov.uscis.gov/processing-times. If your receipt date is before the “Receipt date for a case inquiry," you can submit an e-request at egov.uscis.gov/e-request/Intro.do." does this means that Biometric was fine and paperwork is now being looked at or what?

          This may be because PD is different. Is PD the same for both of you?

              No, think about the number of application USCIS might have received between your (Oct 27) & hers (Oct 29) - it must be in thousands. USCIS process the cases in the order they are received in their system (not when they are delivered)

                Yes , My 4 year old biometric status is not reflected even after 3 weeks. How many weeks completed after biometric for your child ?

                  I am not sure if what you are saying is correct. Just because visa numbers are available, everyone who is eligible won't get their GCs before Sep 2021. The processing delays would definitely cause some of the visas to go unused if USCIS is unable to clear the backlog quickly (which seems unlikely that USCIS could clear the backlog in the current state of affairs). If this happens then I am not sure if those visas go wasted or if it will carry over to the next year starting Oct 2021. May be some experts here can shed some light on this.

                    I think they don't update for less than 12 or something. Check if anyone less than 12 got updated. My son is 9 years old and same case

                        I dont think, the country matters anymore after filing I-485. Do you have the same NBC local center? That may explain a lot.

                          I believe country of birth matters even after I-485 is filed. Otherwise, there wouldn’t have been a country-wise distinction for Final Action dates. Or did I get it wrong?

                              Interview scheduled for i-485 based on USCIS online update.


                              No updates about EAD ?! why ?

                                I understand that whatever we predict may or may not happen. USCIS has taken a big step if they implement it for all is to remove the interview which will should save some time.

                                Are you talking about significant USCIS delays with respect to a specific news or information that you have. Please share with everyone if you do. After writing my post previously I did come across an article that USCIS is having significant delays due to ASC capacity restrictions for conducting biometrics which is why so many of October filers are still going through this and a lot of independent EAD processing has taken a big hit because the previous administration made it mandatory for biometrics even for H4/ L2 EADs.

                                My only point of view regarding Sept 2021 is if USCIS fails to approve GCs and a big number is still in processing then the priority dates would retrogress a lot which would not be good so hoping that does not happen. EB based GCs dont roll over anywhere if they are unused. They just go unused. Only family based GCs roll over to EB. At least that is what I read somewhere when this was a hot topic in Sept 2020.
