I received a letter from USICS stating that my Employment Based (EB3) I485 was administratively closed. This is the exact wording of the statement given:
You filed you form I-485 on October 11, 2019. The Visa Bulletin for October 2019 shows that the priority date for your visa classification must have been before January 1,2009 (which was the final action date), in order for an immigrant visa to be immediately available.
The USCIS visa bulletin website shows that your visa classification can only file a form I-485 based on the final action dates chart (this is incorrect, as the october 2019 VB allowed for filing dates in the employment categories).
The priority date for your immigrant petition is October 12, 2009, which is after the date listed in the bulletin. Therefore, your priority date, based on which you are basing your eligibility to adjust status had not yet been reached when you filed form I-485. You have provided no evidence to indicate that you were able to file on any other basis. Because of this USCIS should have rejected your form I-485 when filed. Therefore, USCIS is refunding your I-485 filing fee. No further action will be taken on this application.
You may not appeal this decision. This action does not prohibit you from filing for immigration benefits in the future.
I have contacted the USCIS call center, they advised me to write a letter to the field office. I wrote it.
Any other suggestions. Has anyone experienced this issue now or before and can guide.
