  • USCIS Saying They Never Received Our Evidence?

    Hi all,

    We had our interview in January 2020. We were separated for our interviews. I went first (US citizen), then my husband. The interviewer did not believe my husband lives with me and asked for our mortgage refinance documents (this is a big packet). We received the RFE and sent the packet of documents in, as requested. We had tracking and signature confirmation that it was in fact picked up.

    9 months later, it's October and we still have no status update. I figured this could be normal due to COVID and current processing times, but figure I would call anyway to see if there's any update. The representative on the phone tells me they have NO record of receiving these documents. I burst into tears, thinking we've wasted all this time waiting for nothing. The agent put in an inquiry about this. This is what I received in my email:

    "On 10/27/2020, you or your representative contacted USCIS concerning your I-485 Application to Register Permanent Residence to notify us that you believe your case is outside of our normal processing time. Below is a summary of what we found and how the issue has been or may be resolved.

    Based on your inquiry, we have reviewed the status of your case and found that it remains under active examination. This office acknowledges the completion of your case being outside of the normal processing time and realizes the inconvenience it may cause. The delay has been necessary in order to ensure the thorough processing of your case and provide you with the best possible service. USCIS will notify you as soon as possible if any further information is needed from you, or when a decision has been made."

    What can I do? I don't even know if the information was relayed to the local office. We DID send the information. We were waiting for a response. Do we send it again??? I don't know what to do now. We are beyond frustrated.

    I am not a lawyer, but I would suggest sending again. Also sign up for an account at my.uscis.gov and add your case by receipt number. Whenever an update happens, you should get an email. When the response to RFE is received, the status changes to something like "Response to RFE was received on date X". This will be a good way for you to track if USCIS actually did something with your package after it was received. Sorry to hear that they managed to lose the packet after it was signed and received by them.

      Sorry to hear about this. I'd send it again and include a letter documenting all the actions taken (including dates, phone numbers, who you spoke to etc. as much as you can) since their last notice to you. Get certified delivery and retain proof of delivery. Then keep calling them every week asking to speak with a Tier 2 officer. If you don't see progress, call your congressman/senator and include the above documented details. They owe a quick resolution and given your priority date, I expect you should get an approval or interview call (more likely) soon. All the best!
