  • Not enough bona fide?

    Hi guys, we have interview coming up in December. Married to US citizen. We have been together for almost 6 years and married for almost 1. I’d like to list things that we have in common which is not a lot at all, we did things that work for us, and it’s been working great so far but now that this interview is coming up I feel like we don’t have enough? Husband feels very confident, he feels like anyone can get things on paper, and the officer will be able to tell whether this is real or not without extra paperwork. We don’t have a joint account as of now because we didn’t need it, he pays all the bills and I use my money towards groceries and little things here and there. We also don’t have a lease agreement as we stay with his family because we are saving money to buy a house. Anyways this is what we have:
    joint tax return (I was also thinking about bringing my own tax returns from past 3-4 years that show the same address)
    drivers license with the same address and new last name
    joint car insurance
    phone bill
    2 car titles (he got one for me in may but it’s in his name)
    engagement ring receipt from 2 years ago
    a bunch of photos with families
    and that’s about it

    02/20 - package sent to USCIS
    02/23 - package was delivered
    04/14 - NOA letter receipts
    05/01 - courtesy letter about medical
    08/04 - NOA biometrics appointment notice for 08/13
    08/13 - biometrics done
    08/14 - case was updated to show biometrics were taken
    08/18 - case is ready to be scheduled for an interview
    08/25 - EAD card is being produced
    08/26 - both EAD and travel have been approved
    08/28 - EAD card was mailed out
    09/02 - combo card received
    10/29 - Interview was scheduled, waiting on notice to arrive
    12/03 - Date of the interview

    To be honest, not having a joint bank account is quite of a red flag. If you've been together for so long, it is kind of strange for them already.

    You do not need to bring your taxes and show those to them. YOU ARE NOT SUPPOSED TO BE WORKING, REMEMBER? However, it is good to show good moral. I would bring them and have them as a secret weapon in case something goes bad and show those only if they ask (They will not ask for them, trust me).

    Does the phone bill show a family plan? Both names in the bill?....

    Look, you've been together for a long time. I feel like you need a little bit more of documents.

    What did you send them with your original package?

    In my case, I applied for AOS in June 2020. Same sex couple, married to USC.

    We got married in January 2020, I didn't want to apply right away, not until we had enough bona-fide evidence.

    I sent them along with the forms;

    -Copy of ID's with matching address.
    -Car Insurance showing both names.
    -Renters insurance showing both names.
    -Apartment lease showing both names.
    -We have two joint accounts, both accounts show transactions made with two different card numbers, his card and my card.
    -Copy of my credit card where he is an authorized user, one card under his name and the other under mine.
    -ComEd bills showing both names.
    -RCN bills but it shows my name only.
    -USPS delivery email print outs showing that both of us get mail at the same address.
    -We are not that photogenic, so we sent only about 12 pictures.
    -3 affidavits of friends confirming our relationship.

    Hopefully you'll be able to gather a little bit more. But as long as you are confident and your marriage is a real bona-fide you should be absolutely fine.

    -01/27/20: Same sex couple, married to USC.
    -06/29/20: Package I-130, I-130A, I-131, I-485, I-693, I-765, I-864, I-864 joint sponsor and I-944 sent via certified mail USPS.
    -06/30/20: Delivered by USPS and signed by Chicago lockbox T Thomas.
    -07/25/20: Checks cashed.
    -07/30/20: Text messages received with case confirmation numbers.
    -07/31/20: Received NOA's in the mail.
    -08/05/20: Received RFIE notification from USCIS for I-485, letter to follow via mail.
    -08/10/20: Received RFIE in the mail asking for my partner's pay stubs for the last 6 months and letter of employment.
    -09/18/20: Mailed out RFIE to Lee-Summit's office.
    -09/21/20: USCIS confirms they've received RFIE.
    -10/27/2020: Called USCIS regarding biometrics appointment not yet scheduled. USCIS send E-Request to Chicago FO.
    -11/10/2020: Immigration officer reaches out to me via phone call to explain the reason I haven't received a biometrics appointment, appointment will come eventually.

      I have two pieces of advice:

      1. Get a notarized affidavit/letter from the family members stating that you are living together with them. Also, if you have any other evidence that you all live together with his family-- emails, bills, etc. bring that too.
      2. Be prepared to explain to them honestly all these things. Including the bank account situation. They may understand and be willing to disregard that if the rest of your evidence is convincing. If they ask for financial documents, just hand in your joint taxes.

        1. Does your husband have health insurance? Are you listed as a dependent on his health insurance policy? If yes, bring proof. I brought a printout listing my wife as my dependent. My previous insurance carrier listed both our names on the actual card.

        2. Does your husband have life insurance or 401k accounts? I listed my wife as the beneficiary and printed out the proof.

        You stated that your husband feels anyone can get anything on paper... Okay so do it! This is literally the most important interview you will ever have. Failing this interview can be a disaster! The burden of proof is on you so take everything possible!

        If your husband is that confident and wants to 'roll the dice', well, okay then.

        Technically, your interview is called an 'interview'. Don't let it become an interrogation.
