  • Marriage based AOS urgent/important question, help please.

    Hello all,



    We recently had an interview for my husband I-485 AOS and it went well as far as we know. There is an issue here, We been together from many years and married after dating close to 5-6 years. My dad was very happy and witnessed our wedding and signed our wedding in the court. After 3 years of happy marriage life, he started to trouble my husband and me and asked me to divorce my husband, if not he will report to the U-s-c-i-s that my husband married me for GC. During the interview, the officer questioned me about how my dad feels about the wedding and why he thinks my husband married me only for GC.(which is not true, my dad complained out of personal hate and trying to prove to u-s-c-is that it is not valid even though my husband and I are honest)



    The officer asked us general questions and later said I am unable to make a decision at this point and I will mail you a final decision. I am very worried about the outcome even though my love and relationship are strong and real.


    please advice and suggest what might be the case in this situation. Thank you all.

    There's a lot of details missing here.. Did you file with a lawyer? How did the officer know what your dad thought, did he file a formal complaint? Why?

    Anyway, it sounds like you've been married for 3+ years and together for 8+, which is a very long time to be together just for a green card. That's a strong factor in your favor and I'm sure you have plenty of evidence.

    Everyone gets "we can't make a decision yet" at the interview, decision usually comes 1 day to 1 month later (depends on the case and the officer, etc.).

    It's probably best to just wait a bit and see what happens. Not much to do now. USCIS can come to your home to investigate for fraud but I think they usually would do that before an interview, not after.

    Hang in there.

Everything is fine, we are staying in my father’s home as I am going to school in the same state and my husband has job in another state and was frequently travelling. Lately, due to some personal issues, my dad started to argue with my husband and me and threatened me to divorce my husband if not he will complain to u-s-c-i-s that the marriage is not real. He opened our interview letter without our permission, took a photo of it and drafted a complaint and sent it to the office building in which my interview is scheduled. He did that before the time and date of my interview. My interview started as usual and the office who is really cool and composed asked us general questions, and towards the end of the interview, he asked me how my dad feels abt the marriage. Then he asked me why my dad thinks my husband married me for only GC. We both explained, and showed us the love and photos we took all these years and my dad himself getting us married. The office was cool and concluded the interview saying, I am unable to make a decision now and will send a decison in the mail. I am bit worried about this whole situation.

        I am sorry for saying but your dad is a total b***tch....

        My timeline so far:

        -01/27/20: Same sex couple, married to USC.
        -06/29/20: Package I-130, I-130A, I-131, I-485, I-693, I-765, I-864, I-864 joint sponsor and I-944 sent via certified mail USPS.
        -06/30/20: Delivered by USPS and signed by Chicago lockbox T Thomas.
        -07/25/20: Checks cashed.
        -07/30/20: Text messages received with case confirmation numbers.
        -07/31/20: Received NOA's in the mail.
        -08/05/20: Received RFIE notification from USCIS for I-485, letter to follow via mail.
        -08/10/20: Received RFIE in the mail asking for my partner's pay stubs for the last 6 months and letter of employment.
        -09/18/20: Mailed out RFIE to Lee-Summit's office.
        -09/21/20: USCIS confirms they've received RFIE.
        -10/27/2020: Called USCIS regarding biometrics appointment not yet scheduled. USCIS send E-Request to Chicago FO.
        -11/10/2020: Immigration officer reaches out to me via phone call to explain the reason I haven't received a biometrics appointment, appointment will come eventually.

          Wow. I'm really sorry to hear that.

          Hopefully the officer will clearly see that such a long relationship is not for a green card.

          My advice is to not worry about it right now because you have already done everything you could.

          I would also suggest that you consider changing something so you no longer live with your father, if possible. I know it's a big change, but maybe complete your studies in the same state as your husband's job and just live together w/o dad. I know it's not always so easy, but it sounds like it's a very negative environment.

            1/20/2021 Check cashed; Receipt text messages hours later
            4/19/2021 Biometrics done
            4/22/2021 Case shown fingerprints taken
            5/10/2021 I-765 Approved; I-131 Approved; new card being produced
            5/17/2021 Combo card received
            8/17/2021 Interview Scheduled
            9/20/2021 Interview finished; I-485 approved new card produced
            9/25/2021 GC in mail

              OMG you dad should be arrested for interfering other people's lives and legal matters...and yes, I also think that he is a total B*tch; you guys might just have to live without him LOL
