RFE after i-485 interview

Hi guys. Did anyone had experience receiving a rfe after their green card interview? And does that mean the Uscis is thinking about denying your case? Thanks for your help!

I have read several cases where people receive an RFE. Most for new I-693 others for other evidence. Depending on what they are asking they may be inclined to deny.

So my adjustment of status is based to a marriage to a US citizen, im adjusting from j1 visa overstay (2 year rule does not apply). So first thing when we got there to the local Uscis office they separated us. My wife (the US citizen) went inside first and the IO was asking her questions for 15-20 minutes. The IO didn't ask her any marriage related questions she was mostly asking questions about my parents. After that she called me in and we went through the form i-485 and made corrections to the things that changed since we filled out application. Then she asked me why nobody from my family side was on the wedding day i told her that they need a visa to come here and its not easy to get a US visa plus they dont speak any English either. She was kinda pissed saying its a big day and they should've came. I said my dad was trying to get a tourist visa a couple of years ago and he was denied and my mom has health issues and wouldn't be able to come. She kept pushing that they should've came i said i was scared my dad is gonna be denied again and i didn't want my sick mom to come here and risk her health. Plus keep in mind i was out of status of the time too, and also it would cost a lot of money for them just for the tickets alone, which they dont have. Anyways long story short we barely talked about our marriage it was mostly about my parents. Then she asked me about how we handle finance. We have been married since December 2019 and when i filed our application in June at that time we sent the 2019 Joint tax return, pictures of us together, bills, we sent as much as we had at the time. In the meantime we gathered more evidence which i brought to my interview including the completed medical exam which she said was okay. Anyways, she told my wife she didn't want to see the additional evidence we brought because it looked "messy", which it didn't at all it was all ready in the box ready to go. So she told me she is gonna send me in the mail letter for additional evidence or notice of intent to deny she is not sure which one. Thats how my interview went today. So im wondering if anyone was in the same boat as me and would they recommend hiring an immigration attorney at this point. Any help would be appreciated. Thank you

You should hire a good lawyer...It always help to have a third pair of eyes looking at your evidence..A good lawyer will know how to argue your case for you if they decide to deny your case..Don’t give up yet..Talk to your lawyer and tell them everything..I wouldn’t loose hope just yet, especially if you know it is a genuine marriage..Good luck..

I'm assuming the IO may not believe the legitimacy of the marriage and it will be up to you to provide sufficient proof. I was in a situation where RFE was requested after interview. IO wanted more proof of legitimacy of marriage. I was able to gather some additional documents for them and wrote 4 affidavits from my mom, my ex husband's dad, myself and my husband confirming the marriage was entered in good faith and is legitimate. Send random pictures of us that detailed the yrs of our relationship. We barely had joint items because I didn't have SSN until a few months before the interview. Either way, try not to stress too much about it until you know what exactly they want. Once you get the letter come back here to ask questions and I'm sure the community will help you.

Its not like we got married right away as soon as i came here so they can say that! We got married in December 2019, and we were 23 and 21 at the time. The RFE is specifically asking for the evidence from June 2018 like joint bank accounts which we didn't have at the time cause we weren't even married. This is driving me insane. We did file an application using Simple citizen website and got a lawyer reviewed our application saying its good to go. This time we are gonna hire an actual lawyer and fight this thing for sure. They gave us until February 2021 to give a response. No giving up! Thanks everyone for an advice to hire an immigration attorney

Trust me i was as shocked as much as you were! Anyways my wife got an i-130 RFE today. It says that they believe that i didn't have an intent of returning to my home country when i came here on a j1 visa in May 2018. That was my 3rd year in a row of coming as a j1 student since 2016 and i definitely didn't predict the future at the time and knew that i was gonna meet my future wife in June 2018 at the same workplace. Its not like we got married right away as soon as i came here so they can say that! We got married in December 2019, and we were 23 and 21 at the time. The RFE is specifically asking for the evidence from June 2018 like joint bank accounts which we didn't have at the time cause we weren't even married. This is driving me insane. We did file an application using Simple citizen website and got a lawyer reviewed our application saying its good to go. This time we are gonna hire an actual lawyer and fight this thing for sure. Looks like they need more evidence of co mingling of finances and other “strong” evidences..I saw someone included a last will and testament and also life insurance policies as well..Don’t give up..Lawyers are expensive but good ones are worth it..Good luck..

This is just crazy! That IO is a piece of work. I think a letter explaining your timeline the way you explained it in your respond to me should suffice. Hopefully the lawyer isn't super expensive especially since as you guys have already done most of the leg work.
