  • How long should I be residing in the same address BEFORE filing AOS (I-485)?

    Hello guys,
I'm so grateful for the information I've found here. I hope someone can help me clarify this concern:

I became a US citizen in October/2020 through Naturalization. My mom came to the US in Nov/3/2020 with a tourist visa (so she meets lawful entry and all the requirements to adjust through me as a sponsor). I'm following the 90-Days rule to avoid a denial due to "intent." However, my lease is expiring, and will be moving to a new city, county/district. I was wondering if there's any requirement for the Adjustment of Status if my mom has lived less than 1 month in the new address. This new address will show in the I-485/I-130 and all the immigration forms. My mom is also in the lease and will have her Driver's License with the new address. I'm wondering this because the requirement for Naturalization was 3 months of living in the same address/district.

Thanks so much in advance for your help :-)

I don't think there is a requirement before filing AOS.

What is not "typical" is for someone on a visitor visa to be part of a lease or to get a driver's license before AOS.
Nov 2018 - Package sent - EB - Texas Service Center
Day 1 - Package received at the lockbox
Day 999 - Card delivered to me - Aug 2021

As far as I know there's no requirement.

Most of the forms however, ask for the address from the past 5 years.

      My timeline so far:

-01/27/20: Same sex couple, married to USC.
      -06/29/20: Package I-130, I-130A, I-131, I-485, I-693, I-765, I-864, I-864 joint sponsor and I-944 sent via certified mail USPS.
-06/30/20: Delivered by USPS and signed by Chicago lockbox T Thomas.
      -07/25/20: Checks cashed.
-07/30/20: Text messages received with case confirmation numbers.
-07/31/20: Received NOA's in the mail.
-08/05/20: Received RFIE notification from USCIS for I-485, letter to follow via mail.
-08/10/20: Received RFIE in the mail asking for my partner's pay stubs for the last 6 months and letter of employment.
-09/18/20: Mailed out RFIE to Lee-Summit's office.
-09/21/20: USCIS confirms they've received RFIE.
-10/27/2020: Called USCIS regarding biometrics appointment not yet scheduled. USCIS send E-Request to Chicago FO.
-11/10/2020: Immigration officer reaches out to me via phone call to explain the reason I haven't received a biometrics appointment, appointment will come eventually.
-11/23/2020: USCIS files another E-Request for biometrics.
-12/04/2020: USCIS confirms biometrics appointment has been scheduled and letter with details is in the mail already.

I hope everything went well in the Biometrics appointment :-)
I remember that the picture they took in that appointment was the one they used when printing my green card

This is a good point. She has had a US driver's license since 2015. DMV gives her a license for the time of admission. Meaning that she only gets a DL for 6 months every time she comes to the US. It's good to have one when she drives.

An interesting point is that visitors pay $70 for a 6-months Driver's License. We, the citizens, pay $25 for an 8-year DL. I'm putting her on the lease because of the Public Charge rule because she neither has an SSN nor a credit report/score
