  • Adjustment of Status

    Hi All,

So I have a couple of questions regarding my current Status, and I would like some insight on what is right. I got married in March to a citizen. I am currently on my H1B Visa. We applied for my EAD/AP in June, and I have received my biometrics date for Aug8th. Now, my lease expires here in Virginia on Aug 1st, My husband and I would like to move to NJ and he already rented an apartment. As soon as i get my EAD/AP papers I will quit my current job, and move with him. However, it seems like there is a problem if you change your address from one State to another. Since I do not want to leave my job till i get my EAD, i will be living temporarily with a friend (since signing a lease makes no sense at this point). Can I then apply for a change of address in the same State, since technically I will be in the same State, working here, till i get my EAD. Once I officially move to NJ with my EAD, can i then apply for another change of address to NJ? That way, there will not be a delay in receiving my EAD/AP (they say if you apply for a change of state, there is a certain delay in receiving the EAD/AP). Once I have my EAD/AP I can quit my job, move to NJ, and apply for a change of address again for the remaining paperwork (greencard and citizenship).

    Please advise?

Keep it simple and try to negotiate a month to month lease with the landlord/management company. I've heard horror stories if you move while your case is in final phase.
    good luck!

I've heard change of address really delays your application. I am in NJ but want to move to Virginia but can't 'coz I'ce filled my wife's AOS in NJ. My lawyer told me to expect a delay of anywhere from 6-9-12-15 months if I did that and to be ready for an extensive interview.

Yea mee to. I know this guy got his passport stamped for I-551 in 2003 but never recieved his GC coz he moved after his interview and INS didn't forward his GC and it came back to them. After a year, they cancelled his GC. In 2005, when he went to Immigration, he was arrested on the spot for being illegal. DON'T MOVE TILL UR CASE IF OVER. SINCERE RECCOMENDATION

          Thanks Guys.

My AOS interview is on the 22nd of September. I am still here in Virginia, staying put as advised. However, I will let the officer know of my plans of moving out of State to New Jersey soon. I have already received my EAD and AP, and I hope to have my passport stamped with the Greencard stamp on the 22nd itself. I have given a permanent address in Virginia just in case. Does anyone have any experiences in the Norfolk center?
