  • i-485 application process when i-140 approval in pending

I am currently L-1A visa holder and my I-140 has been filed last year September and priority date September 15, 2020.
Can I file i-485(AOS) now? Is there any recent restriction filing i-485 priority based on filing date?
What additional forms I need to submit along with i-485?
Do I need to complete medical test before filing i-485.
What forms need to be submitted for my wife and daughter (we all born in India).
I really appreciate if anyone clarify recent process applying i-485(AOS) and respond my questions.

To know if you can send the I-485 you need to visit: https://uscis.gov/visabulletininfo

For people born in India, the priority date needed for:
    - EB1 - 01SEP19
    - EB2 - 08OCT09
    - EB3 - 22MAR10

My guess is that your case is EB1. When the USCIS site allows you to file, you can send the I-485. Follow the instructions for the form to know what documents you need. Every document needed that is not in English must have a translation. You don't need to do the medical exam before sending the I-485, it is only valid for 2 years and some cases take more than that.

You may want to send I-765 and I-131 too, just be aware if when you file those forms need a payment or not.

I hope you can file soon but expect that you will be able until Oct when they enter the new fiscal year.
Nov 2018 - Package sent - EB - Texas Service Center
Day 1 - Package received at the lockbox
Day 999 - Card delivered to me - Aug 2021

Thanks a lot EnuB4 for your response here.
Since my second extension is going to be expired Jan,2022(so I-94) and max out in Sep,2022, I am not sure my company will apply for further extension of my L-1A visa for remaining 9/10 months. In that case, if I can apply AOS by Oct, 2021 along with I-765 and I-131, can we get EAD with AP so that I can continue work here? How long it will take to get EAD with AP usually?
After applying I-485 and not received EAD with AP, can I still continue to stay in USA even after my I-94 expires?
Whats the possible action from my end if you please suggest.

Yes, after filing 485 (AOS), person can stay. However in order to continue work, person should have valid visa or EAD.
