Hello,
I am helping my in-laws with their I-485, and cannot make up mind on how to accurately answer questions 48.a and 48.b in Part 8.
My father in law is from a country that requires men to serve in the military for a few years.
(Part 8 - 48.a: Have you ever committed, threatened to commit, attempted to commit, conspired to commit, incited, endorsed, advocated, planned, or prepared any of the following: hijacking, sabotage, kidnapping, political assassination, or use of a weapon or explosive to harm another individual or cause substantial damage to property?)
For Part 8 - 48.a. , we initially checked "Yes", figuring this would apply to anyone who has served in the military. However, I then began thinking about the question more - and I'm wondering if it's asking about my father in law as an individual actor. That is, he has never done any of these things on his own accord. As he has never done such things on his own accord or a private citizen, would the answer be no? Or, does anyone who serves in the military have to answer yes to this question?
(Part 8 - 48.b. Have you ever participated in, or been a member of, a group or organization that did any of the activities described in Item Number 48.a.?)
For Part 8 - 48.b., this question seems to be more about those who have engaged in the activities mentioned in 48.a. as a member in an organization. As he served in the military, we would answer "Yes".
Alternatively, are all the Part 8 - 48.* questions meant to be about any activities outside of military service? After all, question 49 asks about military service.
Ultimately, we just want to ensure we accurately answer the questions as best as possible.
