  • Divorced and re-married. How to withdraw old application and send new one?

    Hi everyone, I got divorced last year and I am currently re-married and expecting a baby with current husband. My current i-485 is from 2018 and with my ex-husband, we were never called for interview until 2 days ago i received interview letter for my 1-485 from 2018.

    1st: I am wondering what i need to do to withdraw the application.

    2nd: do i need to withdraw it before filing a new one with my current husband or can i go ahead and file the new application? the old application is in GA. The new one will be in Texas

    3rd: should i cancel the interview or go for the interview and withdraw in person?

        Hello,
        My AOS wife and I went through the same thing nearly two years ago. You absolutely must withdraw in writing within 30 days of the NOID (Notice of Intent to Deny which you will likely get if you attend your interview) and it could take up to 6 months for a USCIS response. The USCIS withdrawal response will note that you did in fact withdraw within 30 days. You must then re-apply and wait for another interview date. If you do not withdraw within 30 days of a NOID you will be barred from re-applying permanently. I HIGHLY RECOMMEND you get an immigration attorney immediately.
