  • Immigrant parent with pension: need Affidavit of Support?

    I have petitioned for my mom's green card, and now am preparing to file her I-485. She has pension income that is greater than 125% of Federal Poverty Guideline.

    Do I need to include an Affidavit of Support from my side, or is she OK on her own, with her Declaration of Self Sufficiency?

    Is there any reason for me to include my Affidavit nevertheless?

    You, the petitioner, are required to file an I-864 for her I-485. She is also required to file an I-944.

      To simplify the application and reduce the documentation required, would it be a good idea to not declare any income, assets, or educational/ skill qualifications in the I-944, since my Affidavit will have enough resources to support my retired mom?

        No, that is not a good idea. It is considered a negative factor to have a household income of less than 125% of poverty level on the I-944. Lack of education and skills is also a negative factor.

          Is it also a negative factor to not have health insurance coverage? Should I get one before filling the I-944?

            My mom is way past retirement age. Would any amount of skills or education affect her probability of becoming a Public Charge? She will not be working any more or monetizing her skills and education.

            It will be such a headache to obtain proof of her education (graduated 50 years ago)

              Is something like this acceptable?

              I would include myself in the household of my mother (the immigrant). For all income and assets, I would show mine (same as in my Affidavit of Support). All documents my mother would submit as evidence of Self Sufficiency, would be about my income and my assets in the US, rather than hers in India......

              Would that work? It will save us so much hassle, because all my assets and income in the US is easily documentable
