  • legal status after i file i-485

    i have filed I-485 and my case status says initial review.
    i came on visitor visa and my i-94 is expiring soon.
    at this point, should i apply for extension of visa?
    if not, how soon i have to leave us, if uscis denied my i-485.
    please answer, if anyone know.

    What is you case category?
    If you accrue six months of unlawful stay, you can be barred for three years.

        When did you file your I-130, what is your priority date?
        If your PD is current and after you mail your application, it can take anywhere from 4 to 6 months provided all your documents and application was in order.

          yes, my PD is current, thats why i filed i-485.
          the case status of i-485 shows initial review.
          my i-94 expiring soon, at this point should i apply for extension to maintain legal status?
          if not, then how soon do i have to leave from US, in case of denial of
          my i-485?

            I-485 under F-4 should not be denied until and unless there is a problem. If you apply for extension, it takes a while. Like I said it should take anywhere from 4 to 6 months. Maybe you want to consult with a counsel, the ones who offer free initial consultation.
            I would for sure not go in unlawful status.
