spouse 485 denied - please help!!!!
Huge blow!!!!!!!!!! My wife's 485 got denied.
I just got an email from my attorney saying that my wife's 485 got denied. Couple of months ago we have answered a critical RFE regarding her status when we have applied for I-485. According to INS she was not on valid non-immigrant status when we have applied I-485. INS says, that is the basis for the denial. I did not get a chance to talk to my attorney yet.
Question is....how bad is this??????? When we were answering the RFE, attorney told me that if they deny the case we need to apply I-824 and she needs to be in India for while. I am in total jeopardy now.
Note: mine was approved in Sept’ 04
Any suggestions ???????????????
