  • HELP NEEDED PLEASE Request for Evidence Arrival and Departure Record

    My mom was here in the U.S. in 2017 and she left the states before her visa expires and she comes back last year and I had to apply Green card for her and I-485, I sent all the forms and I just received a Request for Evidence letter asking for Arrival and Departure Record for her 2017 visit. I checked the I-94 website and no record for the departure only arrival.

    I need help regarding this situation. Where can I get this record?

    The only thing that I can think of is getting a copy of her boarding pass from the airline that she departed with.

      the I-94 site will only give arrivals (as you've noticed). In the past I have supplied receipts showing flight details as evidence of travel.

      08/22/22 - Day 567 - New Card is being produced!!!!

        USA only tracks arrivals. For evidence of departure, things like airline tickets, boarding pass and arrival stamps from the other country.

          Thank you for your answer, Unfortunately I don't have the flight receipt. Any other options?

            There is an option to print the travel history in the i-94 site. It logs the departure date as well as the arrival date and location. Its right there alongside get most recent I-94. Did you try that?

              I don't understand why they would want a previous stay's I-94, as AOS in the Immediate Relative category does not require that the person maintained status. Perhaps they want to know the I-94 end date to determine whether she accrued unlawful presence for the purpose of the unlawful presence ban. If she didn't save a copy of her I-94 during that stay, it's hard to get it now since she already left after that stay. The travel history will not show the I-94 end date. She might have to make an FOIA request for her previous I-94 records.
