  • H1B not stamped, but have Parole, can I travel abroad?

    Not long ago, I have received my "Employment Authorization Card" and my "Authorization for Parole of an Alien into the US", as part of my green card process.

    My current status in the US is H1B holder, however the H1B stamped on my passport is expired, and My H1B extension was approved but it has not been stamped on my passport since I have not visited Mexico, Canada or my country of citizenship Spain for such purpose.

    Since I have these new documents of the green card process with me, Do I need to worry about the H1B stamping for traveling? I need to know if I can leave the country for a week and come back without any problems.

    anyway, i will post the answer i have obtained from a lawyer so that it could help another person in a similar situation

    Yes you can absolutely travel on the Travel Document and the EAD.
    Mind you though once you enter the US on the Travel Document you have necessarily given up your H-1. No harm, since you do have the EAD and the AP, But they are only valid for 1 yr and you need to renew it every year till you get the Green Card. With the H-1 it is valid for its entire time frame.

    Check with the US consulate/embassy of the country you want to travel if you can get your H-1 stamped there. Otherwise you can definitely travel on your AP (Advance Parole)
