  • concurrent filing - EB3 AOS and now EB-1 AOS???

    Hi,

    In Oct 2020, husband's priority date of 2014 became current as per filing date. So husband filed AOS-485, 765, AP with wife being derivative applicant on it. Husband is on H-1B.
    Now, wife's employer is filing her GC in EB-1 - multinational manager; however wife is completing her total tenure on current L-1A visa by end of Jun 2021. In such case, can you comment/guide on below?

    1) EB-1 being current from Apr 2021, should husband and wife's AOS-485, 765, AP be filed along with wife's i-140 EB-1 filing? or should it be filed after i-140 approval?
    2) While doing so as mentioned in point 1, should the prior AOS-485, 765, AP be withdrawn that was filed via husband's EB-3 application?
    3) Is there any way to do premium processing for EB-1 i-140 for multinational mgr capacity?
    4) If EB-1 i-140 is filed, is there a way to extend L-1A?
    5) Given current processing times, it takes 3-6 months for i-140 processing. In such case what are the options for wife to continue in USA?

    Is it an option / advisable to have ONLY wife file AOS via her EB-1 i140? While doing so, should she keep her AOS applied that was done previously via husband's EB-3 i-140? Or should wife withdraw her AOS that was applied via her husband's EB-3 based i-140? It looks like it is not advisable to have 2 AOS for same person same time. Please guide.
