  • Need help on filing I-485

    Hello,

    My I-140 just got approved in EB1A, and so, getting my papers ready to file I-485. The problem is that me and my wife's one of the parents last name is missing in their passport. I am not sure how to fill the item no. 1a in the part 4 of the form I-485, and how to take it forward without getting into any issues. I am filing this on my own without any attorney's help. Any help would be much appreciated.

    Friends, did no one come across with this problem? I know the problem of empty last name entry is quite widespread. So, please help.

      I don't think you need to send a copy of the parent's passport, so what I will do is either put the complete name based on the birth certificate or put the name as it is on their passport. I think the instructions say that if there is nothing on a field that they expect something to put N/A. Just my opinion.

        Enub4 Yes, I was thinking to do the same as I didn't get any definitive solution yet. Since, I don't have to send parent's passport copy, I'll just put the name according to the birth certificate. So, the last name is there. it is just that in the passport whole name is written as the first name. I am still hesitant to put N/A in the last name, thinking I might get an RFE or denial.
