  • RFIE for Birth Certificate received for both parents

    Hello Guys,

Hoping some of you would be able to provide some guidance. I had sent in my package on Nov 2020 for my mom and dad. Their biometric is scheduled for later this week. To my surprise, I received an RFEI just today stating to provide copy of the birth certificate for the primary applicant. Got a letter for each parents for I-485

Looking at the copy of the birth certificate I sent last year, I noticed that
    1. The Title of the document says "Birth Registration Certificate"
    2. It does have the government stamp on it
    3. There is a secretary stamp on it as well
    4. The format of the birth certificate is such that its in native language on the right side of the document and translated to English on the left side of the document, by the same authority that provided the certificate. I guess all certificate come like that now.
    5. Entry Date:13 December 2019. Entry Status: Late. I am assuming this is because more than likely my parents lost the original so they had to request a new copy of it.

By looking at #5, i am assuming that's what they are concerned about? but its really hard to say because they aren't really specific on what exactly is wrong with the copy that I provided.

Can someone please help shine some light on it.

Ours was rejected because it was a short form birth certificate and not the long form. Are you sure theirs is the long form? If there is any foreign language on it that must be translated and certified.

Thats what it said on RFE but we got it checked by lawyer and he said it looked fine and that they made a mistake. Where are you from?

Were you able to get this resolved? You have not written which country they are immigrating from, but please refer to the Reciprocity Schedule at the link below to get a detailed description of the requirement for birth certificate and what are considered as acceptable alternatives. Keep us posted.
USC filed AOS for parents on B2. I am not a lawyer.

From the original post, it seems they are asking for "copy of the birth certificate for the primary applicant". How are your parents primary applicant?

From what I read: A principal applicant on Form I-485 is the primary or main intending immigrant named on an immigrant petition. In this case, JFearH is the petitioner and each parent is the principal applicant to get an immigrant visa.

              Hi JFearH,

Can you share your experience and update. How was the issue for your parents resolved?

              Thanks.
