i-485 rfie but no action required

  • i-485 rfie but no action required

    Greetings all! I could use some help to set my mind at ease. On October 1, 2020 my wife and I submitted the 485 in conjunction with the 765 and 131. On November 10, we got receipts for everything but since then there has been no forward momentum on the 765 or the 131. On Feb. 19th we received a notification through the web interface that an RFIE was being sent to us and that no further action would be taken until we satisfied it or the time frame to respond expires. We patiently (not really) waited for the letter and when it arrived it was a notice saying we didn't include the medical form but at this time no further action is required, they will either write us and request it by mail or we can bring it to our interview. Since then, on the webpage, the case has set in this same status of RFIE sent. My main concern is we are stuck in some kind of limbo and that no action is being taken on the 765/131 ead card. Has anyone else had a similar experience? Are there any other steps anyone would recommend to set my mind at ease? Thank you so much for any response!!!

    Hey you might get the RFIE letter later, afaik the deficiency letter isn't marked as a RFE unless they want you to mail the I693 back to them. Why don't you call them just to verify if the deficiency letter was marked as RFIE?

      Thank you for the input. I had called before and man the automated system is brutal. Anyways just called again, the person told me she saw the notice that was sent. I tried to get clarification if this was the rfie and she didn't know. The conversation went in circles and she kept telling me to follow the instructions in the notice and wait. I tried getting the call elevated and she said I could write a letter as my only option.

        Did you get your biometrics done? We are in a similar timelines i.e. applied early october and recieved a biometrics for Dec; following which we received an RFIE for Medicals in Feb but our letter mentioned that we were required to send the medicals and until that's received no further processing would be done. I had sent the medicals promptly but no action on combo card yet.

        In my recommendation, you can send the medicals to the USCIS along with the copy of RFIE that you have received and a cover letter. This may be a chance and you might have to get another medical done for the interview if the status doesn't change but that's what I would do.

          If the letter doesn't say to send the I-693 in a sealed envelope then don't send it.

          Your online status should say that if you didn't receive the RFE contact USCIS. You should contact USCIS if you haven't received an actual RFE that stops any further review of your case.

          I have a good experience with Emma, try that and explain that you need a copy of the RFE because you have not received any RFE that requires a response.

            Thanks for the additional responses! We never got a notification or anything on the biometric appointment. That always freaked me out a little bit but I think we assumed they had used something she had done before? Is that possible? My wife has been here for a long time on a student visa, going through grad and now PHD.

            As the last post states the letter we received as the RFIE said do not send it (693) in, and I am going to follow those instructions to the word. The online status does say to contact them if we didn't receive the RFIE. I functioned under the assumption that they would just send another copy of the 693 but I like you suggestion and I am going to go ahead and request a copy, cant hurt. I did try to contact an actual person, and she was not helpful. Occasionally I hear about some kind of appt you can schedule for a one on one call with a person who actually has information on your case? Is that still any kind of option?

              What all is required in the medical report ?
              Is that something we can do beforehand as I am sure everyone would get the medical RFE.

                The medical report is the form I-693, it is required for all AOS as far as I know.

                You can send it with your I-485 but if you think your case will take a long time, you can send the I-485 without the I-693.

                When they review your case they can send you either:
                a) a courtesy letter, saying that the I-693 was not received and you need to bring that form in a sealed by the civil surgeon envelope to your interview or
                b) an RFE asking you to send the sealed envelope to the Service Center

                Usually, when they send the courtesy letter they don't update the online portal. When they send an RFE that requires sending the sealed envelope and/or other documents, then they update the online portal saying they sent you an RFE and they will stop reviewing your case until they get the documents back.

                So, for kgetz21 case either USCIS made a mistake and sent a courtesy letter but registered online that they send an RFE, or they sent 2 letters, one courtesy letter and one RFE that is yet to be delivered.

                  Hey just wanted to provide a quick update in case someone else gets into this status. I used the live chat function yesterday and was provided the following details of my status. My account was set to RFE, then 9 minutes later it was cancelled, 4 minutes after that it was marked medical. So apparently the online portal does not update on that which is why it still says RFIE as my status. I would recommend to anyone who has questions to use the live chat function through the website, launch the chat function, then type live chat in. It was soooo much more helpful then calling.
