  • I-485 approved

i just want to give something back to the website for all the useful information it provided! My I-485 was approved on Aug 4, 2010 after 2 years of waiting for the whole process to finish. it was a long wait but it was worth it because i can be with my husband now without having to worry about visas!!!
Am a southern European and my husband is american citizen by birth.

We started the process of K-3 spouse visa 6 months after our marriage, not immediately after the wedding ceremony. The wedding was held in my country! The reason for it is that i had a valid tourist visa and i was going back and forth to visit my husband without problems. MAKE SURE YOU DO NOT OVERSTAY A TOURIST VISA! DO NOT TRY TO EXTEND YOUR TOURIST VISA AND GET ADDITIONAL STAY! MOST TIMES THE EXTENSION IS REFUSED AND THEN YOU ARE RESPONSIBLE FOR OVERSTAYING!!! EVEN IF YOUR CASE WAS PENDING!!!!MAKE SURE THE DEPARTURE from the USA AND the next ENTRY ARE NOT WITHIN DAYS!!!! AT LEAST 2-3 months APART!!!

We filed in 2008 and i got a notice in 2009 for K-3 spouse interview at the US embassy in my country (always K-3 are done in the country of origin of the non-american, unless the country does not have a consulate or embassy, which then you have to check which country services yours with US consulate services). MAKE SURE YOU USE A USA LAWYER FOR THE FILING OF THE PETITIONS! THE DOCUMENTS MUST BE SUBMITTED IN A VERY SPECIAL WAY, ONLY LAWYERS KNOW! IF YOU TRY TO DO THIS ON YOUR OWN IT WILL BE DENIED! Lawyers are worth every penny. Choose a lawyer that has EXPERIENCE with immigration law. IT IS VERY IMPORTANT the docs are sent the right way!!!

In 2009 i was approved of my K-3 spouse visa! During the interview be honest, DO NOT LIE, they REALLY DO THEIR HOMEWORK and they KNOW things about you, that you may have "forgotten" to mention! Their agencies do their jobs very well, if you know what i mean. When asked a question answer only that and do not try to give more info they did not ask for. Try to dress appropriate and not over do it. Do not dress TOO formal. It raises suspicion. Remember it is just an interview and they are trained to look for anything that may make you uncomfortable. Be calm and confident in your replies. If you don't believe what you are saying, how do you expect them to believe you? They are also trained to be impolite and sometimes rude. Make false accusations and try and make you do a mistake. IF YOU ARE HONEST AND TELL THE TRUTH THEY CANNOT INTIMIDATE YOU! YOU CANNOT MAKE MISTAKES, because the truth CAN ALWAYS BE PROVEN! YOU SHOULD HAVE ENOUGH DOCUMENTS TO SUPPORT YOUR CASE.

After my K-3 was approved i traveled to the USA and then filed for adjustment of status. Within 5 months i received my interview notice for adjustment of status. My husband had to come with me. The interview itself was 10 mins!!!!! the lady officer was very polite and she engaged in conversation as if she was a long time friend almost immediately after she called our names. Both my husband and I were very relaxed during the interview and we did not feel intimidated at all. She opened my file, she asked how we met, my husband started telling her and i jumped in from time to time to support what he was saying. She then asked to see some pictures (bring more than 10 pictures. We had with us 34 pics nicely arranged in a small photo album, with dates and names of people and places). She spend more time going through the photo album than asking questions. She asked to see our marriage certificate which she gave back to me. She did not ask for anything else, although we had brought ALL the supporting evidence mentioned in the USCIS letter. She asked me if i had an EAD and an Advanced Parole Document for travelling but she did not want to see them.

Then she said that my green card was approved and my husband and I could not believe it. We even asked her if the interview was over and she said yes. She then informed us of what the next step is and she shook hands with us having a huge smile on her face. She also said that we were of the VERY FEW COUPLES that do this process the RIGHT WAY and she congratulated us!!!

Big thank you to immihelp for all the useful info! Great site
