  • G-28

Hello, I recently received an RFE for I-485 (adjust status). In this RFE, USCIS is asking.
"Your application contains a Form G-28, Notice of Entry of Appearance as Attorney or Representative, completed by YYYY XX. Please indicate whether you are still represented by this attorney or representative. If you no longer wish to be represented by this party, you may submit a signed statement requesting the submitted form G-28 be withdrawn.
If you have obtained new representation, you must submit a new, properly completed form G-28 containing the original signatures of both yourself AND your authorized representative."

I'm directly responding to the other RFE questions. If I withdraw the legal representation, what are the implications of it?

I appreciate any guidance in this regard.

I don't understand. Do you still have the attorney or not? I guess if you no longer want/need the attorney you can withdraw the legal representation and at that point, the attorney will no longer receive letters for your case and can't go with you to your interview.

Thank you very much for your response. I still have the attorney, but I'm directly responding to RFE since it only requests I-693 and updated G-325-A. I used the attorney for the petition, but otherwise, I'm doing it on my own for EAD renewal and responding to RFE. Do we really need an attorney for a GC interview? Thanks again!

I'm not sure if you need one. From what I know, some lawyers charge a fee that includes them be there in the interview and they charge extra for RFEs and EAD renewals.

My work AOS included a lawyer where they already included in the fee to be present in my interview (now it looks that can be waived), so I did every EAD renewal to save money (simple process) and return the RFE marking that the G-28 still valid.

If there is an interview, the lawyer will be there (don't know how helpful will that be because I think my case is simple), if the interview is waived and they approve the GC, they will deliver the GC to the lawyer.

In the end, is your decision and you need to select what makes more sense to you. Good luck.

Thank you very for your suggestion, Enub4!

I'll go with the existing G-28 is still valid.

          Thanks again,
