My GC priority date is aug 2009(EB2). By end of sep 2020 it was current and only by mid-april 2021, I got RFE (asking for existing or future employment letter).
June 2020 I got laid off and I am not working bcos of family situation in India. I am USA in now and not looking for job as I may have to go back to visit family in India(hopefully once flights resume).
I got RFE asking for Form I-485 Supplement J: "Submit properly completed and signed supplement J. Confirmation of Bona Fide Job offer or Request for Job Portability, showing the offer of intended permanent employment as stated in form I-140 or that you intend to port to a new offer of employment".
INS expects me to respond to RFE by 1st week of July. For now I do not have any lawyer to consult. One employer is ready give me offer letter for future say around start of august 2021(hoping to return from India by then).
Question:
1) Does immigration offer denies by I-485 if i am not employed or do not send existing offer letter?
2) Any one submitted a future job offer letter(with no job offer in hand) and got I-485 approved? Are there any risk submitting supplment J of employer with future offer?
Any advise will help.
