  • I-485 & i-130

    I became a citizen in Feb 2010 through Naturalization.

    I married my wife ( after 8 year relationship) in July 2010. She is currently on a L1 Visa that expires in May 2012. We both live in NYC.

    We want to adjust her status to Green Card holder and need some help to make sure we file all the correct forms and send them to the correct address. We are trying to avoid hiring a lawyer as it is expensive enough to process this without having to pay lawyer fees.

    Medical has been completed and will be picked up this week. (I-693)

    We have completed the following forms I-485, I-130 and I 864.
    We have also filled out I-765 (employment authorization) and I-131 (travel doc) but are not sure if this is neccessary considering she is able to work and travel under the L1 Visa.

    Questions:

    1. Can we file all forms together?
    2. What address do we send them to? We live in NYC.
    3. Do we only have to send two seperate checks?
    $355 & $ 1010 made payable to Department of Homeland Security?
    4. Do we need to send in the I-765 & I-130 form
    5. We have copies of Birth Certs, Passports, W2's, I94 card, Naturalization Cert, Joint bank account statements, 3 recent pay stubs - is their any other docs we need.

    Any help or feedback would be much appreciated.

    All the information is available at the USCIS site with instructions, forms and address where to mail. Hope this helps!

      yes , my friend u can send all forms at a time, if you file I-765 and I- 131 because no fees for that one.
      Make sure write the cover letter including who is filing for whom and all supporting documents and wedding pic. If you will send them well organized file you wont have any problem.

        If someone could just walk me through what exactly I have to do it would be much appreciated. I have all the forms completed and think I need to just submit to Chicago address with covering letter and supporting docs. Thanks

            Yes you can file all forms concurrently to

            U.S Citizenship and Immigration Services
            P.O Box 805887
            Chicago IL, 60680-4120

            . Cover letter
            • Money order for $355 payable to U.S. Department of Homeland Security.
            • Form I-130: Petition for Alien Relative
            • Two (2) Photos (Petitioner and Beneficiary
            • Copy of Marriage Certificate
            • Copy of Birth Certificate, in your case certificate of naturalization ( Petitioner- U.S citizen)
            • Form G325A: Biographic Information
            • (One for Petitioner and one for Beneficiary)
            • Money order for $1010 ($930 base fee + $80 Biometric fee payable to U.S. Department of Homeland Security.
            • Form I-485: Application to Register Permanent Residence or Adjust Status
            • Two (2) Photos
            • Copy of I-94 (Front and Back)
            • Copy of visa
            • Copy of Birth Certificate
            • Form I-765: Application for Employment Authorization(although not sure she needs that since she is already legally employed but you can read more on it
            • Two (2) photos (if u need to file the I-765)
            • Form I-864: Affidavit of Support
            • Copy of Tax Return
            • Copy of W-2
            • Copy of paystub
            A letter from employer stating the annual income(it should be on the company's letterhead)
            I-693 Medical Examination
            • Form G325A: Biographic Information (For Beneficiary)
            • Two notarized Letters of Affidavits stating the validity of our marriage (it can be from anyone who knows both persons and know information about their marriages).

            about the affidavit of support, I'm not so sure how that works since she is working in the U.S legally....she may be qualified for the 40 points... here is a link you can read up on and figure it out



            Yes it should be two different checks!! Make sure all the forms are properly signed, dated and filled out

              Is the G-325-A form neccessary if my wife is here on a L-1 visa.
