  • Travel to UK with AP (Pending AOS)

Hi! I was wondering if anyone was successful go to the UK during the pandemic with a AP advance parole while AOS in jn progress?

I am in progress of AOS, family based, mom is a lawful citizen with greencard who sponsored me.

On the Proclamation about US Travel Ban, it currently listed that “ Section 1. Suspension and Limitation on Entry. (a) The entry into the United States, as immigrants or nonimmigrants, of noncitizens who were physically present within the Schengen Area, the United Kingdom (excluding overseas territories outside of Europe), the Republic of Ireland, and the Federative Republic of Brazil during the 14-day period preceding their entry or attempted entry into the United States, is hereby suspended and limited subject to section 2 of this proclamation.”

However, it also says that Section 1 doesn’t apply to “vi)any noncitizen who is the child, foster child, or ward of a U.S. citizen or lawful permanent resident, or who is a prospective adoptee seeking to enter the United States pursuant to the IR-4 or IH-4 visa classifications

    My question is
    1. Can I travel and return safely?
    2. Did anyone do this recently during the pandemic?

    Thank you!

Are you under 21 and unmarried? If not, your mom being a citizen or permanent resident doesn't help you with this ban.

There is a national interest exception for immigrants and fiances, but it is not clear whether this applies to Advance Parole holders.

This is my personal opinion and is not to be construed as legal advice.

Thank you! Unfortunately I've passed 21. I thought child here in this case mean son/daughter of citizen since it didn't mention "under 21" like some of other exceptions. I guess that means I won't be able to go to the UK Thank you!
