  • AOS General questions

    Hello All

    I have couple of question because I going to do a concurrent filing of forms : 130,485,765,131.

    1 - Do I have to pay for all of the forms? $535 for 130, $1225 for 485, $410 for 765, $575 for 131 ?
    2- Is there anyone who has done an AOS before the 90 days rule?
    3 - For the bona fide marriage : I have the birth certificate for our baby, photos while dating and marriage, joint account; but I do not have a lease, My parents are renting an apartment and we are living with them. Can my parents write a Letter of accommodation stating that we both live together with our child ?
    4- Can I wait to do the form 693? not sending it with the concurrent file;
    5- Police record, he does not have any police record or crime: does he need still to send it ?

    Thank you

    1.- if you review the instructions for I-765: https://www.uscis.gov/sites/default/...i-765instr.pdf it says:
    NOTE: If you filed Form I-485 on or after July 30, 2007, and you paid the appropriate Form I-485 filing fee, no filing fee is required to request employment authorization on Form I-765. You may file Form I-765 with Form I-485, or you may submit Form I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C Notice as evidence of filing Form I-485 on or after July 30, 2007 and paying the filing fee
    I think you will find the same for I-131, so no fees for I-765 and I-131.

    2.- what 90-day rule are you referring to?

    3.- you must provide all documents that you have that prove that your marriage is real, each case provides different documents. If the joint account, driver's license and other documents show the same address I don't think you need to submit a letter. You can bring one to your interview if you want just in case the officer asks about where you live and if you rent or have a mortgage.

    4.- you can wait to do form 693, they will send a courtesy letter saying form I-693 wasn't received and you must bring one in a sealed envelope to your interview.

    5.- you must provide all requested information. If the form asks for a police record, then you should get a letter from the police that reports that there is nothing on the record. If they ask for a police record from every place lived in the past X years, then you should try to get all letters from the corresponding authority. What form/section asks for a police record? (We didn't file I-130 because we are EB and don't remember seeing that in our I-485 that is a few years old).

    The case is by marriage to USC or GC holder?

    Good luck.
