  • I-485 pending for more than 180 days. Can I use AC21 to move to a new state?

    Hello,

I am on H1-B visa and my employer has filed for my GC (EB3). My I-485 AOS has been pending for more than 180 days. So far, I have only received a letter for biometrics appointment (next month). I have been thinking of moving to a different state to be closer to my family and work from a different office for the same employer. From my research, it seems like AC21 is the process to do it, but I haven't been able to find some specific answers yet.

    1. Is AC21 the right process if I want to move to a different state/city for the same employer and same role?
    2. Who files for AC21? Is it going to be me or is it by the employer?
    3. How long does the AC21 approval take?
    4. Do I need to wait for AC21 to be approved before I relocate, or can I relocate first, and then start the process?
    5. Are there any specific risks related to I-485 AOS, if I move cities?

    Thank you.
