I-485 - Case was transferred to a new jurisdiction

  • Thanks CLAP20 . This helps. My 140 was approved in LIN. My 485 was originally with MSC but then they transferred it to LIN about 14 months back. Now I am waiting for it to be transferred back to MSC or a field office. The intention of moving 485 to LIN was that the 485 was going to be adjudged at the same when 140 was adjudged as my priority date was current but unfortunately LIN stopped processing 485s and I am stuck waiting for them to transfer my case back to MSC. Ideally they should have done it when the 140 was approved but didn't happen.

    • shiva_82 - I think there can be 2 outcomes from LIN, either RFE/approval or Transfer. Dont they review and issue the next steps from NSC rather than transferring?

      Do you know what timeline we should follow now? NSC or NBC? NSC is 18 months but based on my field office (NBC), it is 16 months. I am closer to NBC now than NSC.. Anyways, i did not receive any info since 1 year or so.

        The timeline would be corresponding to where your case is currently. So even if you have a MSC receipt number, if your case is currently with Nebraska, you should use that processing time. Based on my understanding Nebraska stopped processing 485s so the only outcome to expect is a transfer, unless Nebraska had already started working on your 485.

          yes, i assume NSC processing time applies. All of the receipt number above and below me are transferring but no clue about my case number. There are some receipt numbers very recent from 2022 that are being transferred. Not sure why there is a delay in transferring. Perhaps it was kept aside to be adjudicated from NSC.

My 485 had been transferred from NBC to LIN last year for speeding up processing, hopefully they will transfer it back so I could get my GC at the earliest. Regardless, it is definitely such a relief that my I140 got approved!

              For my 485 to get transferred back to MSC, it took about 2.5 months from the time of my I-140 approval. I know its already long for you and you won't want to hear that. Hope you get to hear a good news soon!

                  • How can I find out how many EB1 485s are pending with USCIS? I'm trying to find out my chances of getting my GC this immigration year. Even while EB1 is current, there are no visa numbers for this month. So I'm afraid that depending on the pending applications, even while the status is current, the visas might run out.

                    Even if we are unable to find the pending applications, is it possible to find out until which priority date USCIS have issued GCs?

                      Yes, I dont understand how they operate this. Only reliable timelines we can depend on is 18 months for NSC and the date it displays when you input your receipt number. Either visa numbers are assigned but not adjudicated yet or they havent touched our cases. If they havent touched our cases, then what is the point of keeping it as "Current"?
                      With 2 weeks to go, i lost hope for this year and lets hope for 2023.

                        They won't issue any more GCs this year. They have already exhausted visas in EB1, EB2 and EB3.

                          But i wonder is if they exhaust visas for 2022, then why would EB1 stay current?

                            Because they believe that with the visa numbers coming available in 2023, they will be able to allocate visas to all pending AOS cases. May be as months move by, if they continue to get demand greater than what they anticipate, they might retrogress EB1. That's the scary part because with the dates being current, so many people can file and also because they don't process applications based on a certain order, there is a possibility that people even while their priority date is a few years earlier, might get missed out even while new filers from 2022 or 2023 get GCs. Scary...!

                              Hi! I'm new in this forum - What do you mean they won't issue any more GCs this year? I sent my medicals i693 to the Arizona field office on August 15, 2022 for the FY 2022 as the receipt notice indicated but I still have not seen any updated status

                              • Yeah, i also got the same ask that if I want my GC this year i sent it asap. I sent it on Aug 29th. I am really hoping we get soon.
