      • For anyone in this thread who has filed I-140/I-485 (Concurrently), has your I-140 been approved ? Or is everyone waiting approval ?

          • Today marks one year since my application was submitted.
            Processing times are given as being 11.5 - 19 months (50% completed in 11.5 months and 93% completed in 19 months)
            Historic processing times are quoted as 11.1 months (based on data from October 2021 to December 2021)

            I guess I'm one of the unlucky 19 month people!

            02/01/21 - Day 0 - sent to Phoenix
            02/02/21 - Day 1 - Delivered - signed by F.Brown
            04/02/21 - Day 60 - NOA Received for I-485, I-131, I-765
            04/02/21 - Day 60 - Transfer to Nebraska
            06/29/21 - Day 147 - Fingerprints Taken
            10/01/21 - Day 242 - EAD/AP Combo Card in hand
            07/07/22 - Day 521 - Transfer to Missouri
            07/13/22 - Day 527 - RFE for new I-693
            08/03/22 - Day 548 - New I-693 sent
            08/22/22 - Day 567 - New Card is being produced!!!!

              2021 saw the USCIS backlog continue to grow drastically. Fortunately, roughly 69% of the 8.84 million immigration applications submitted to USCIS in FY2021 were approved, while a little more than 808,000 were denied. However, despite USCIS completing nearly 80% of the cases it received in FY2021, the processing backlog at the agency grew to more than 8 million pending cases at the end of FY2021

                Any updates yet, Shiva? My neighbor applied in July 2021 (concurrent filing) and they got their approval on Monday.

                  No update on my case yet. It is beyond the processing time and I submitted a service request. My attorney asked me not to expect a response as he said USCIS is flooded with so many applications that they might not even take time to review these service requests. I have also seen many who applied after me get approval. I guess it is plain luck as it appears that USCIS delegates some case load to vendors who do the work for them. While some vendors are remarkably quick, not everyone is. It could also be that my case got stuck with someone who is not that great.

                  Anyways, I got an email & text a couple of days back stating that an action was taken on my case but I don't see any update online. Emma didn't see any updates on my case either. So this must just be the service request getting registered.

                  Did your neighbor apply in EB1C category and did they get approval for their GC as well or just their I-140? Would be curious to know. Thanks.

                    Tough luck. I hear the same from my attorney that USCIS is inundated with millions of pending applications. It is just pure luck that our case gets processed. I am not entirely sure if USCIS is strictly processing the applications on a FCFS basis.

                          • Finally I got a status update but unfortunately it is a RFE. I am wondering what the RFE could be about? More than the RFE itself, I am worried that it will only delay me getting my GC and that the EB1 dates shouldn't retrogress by then. Fingers crossed..!!! I didn't expect to see this after waiting for more than a year. It is really frustrating to say the least.

                              They concurrently applied to I-140 & I-485 at NBC in Jul/ Aug 2021 and their I-140 was approved on Monday. They also applied in EB1-C category.

                                Don't worry. Usually once you respond to an RFE, they will approve within a week. Retrogression has no impact to this. Btw, when did you submit your Service Request? I submitted it only on Tuesday.
