I-485 - Case was transferred to a new jurisdiction

    I submitted the service request last Thursday. I got a text this Monday saying there was an action taken on the case but there was no update online. Emma didn't have any update either. I was hoping that something was being done on my case but didn't expect it to be a RFE.

    While retrogression has no impact on the I140 itself, I was worried about EB1 final action retrogressing while I am waiting for my I140 to be approved. Looking at worst case scenario, I might receive the RFE notice only by 1st week in March. Assuming my organization takes 2 months to respond and USCIS further takes another 2 months to process the RFE response, I am looking at mid to late July to get a response on my I140. I have seen that typically USCIS takes a few more months after the I140 is approved before they pick up the 485 so that puts me in the next year in immigration calendar.

      • Got it! I was approved my L1-A extension on Tuesday without an RFE. It was the same documents/ evidences we submitted for I-140. Let's see.

          I didn't ask those details. It was surprising to me too. Seems they have submitted I-140/ I-485 on the same day at NBC.

            I always get a response from an SR. We just did one a couple of weeks ago and got a response around 12 days later. Typical response: "We have had to perform additional review..." but at least it "feels" like I'm doing something.

            Shiva_82, I haven't read all of your posts, have you already submitted your I-693? If not, have you received a courtesy letter or RFE for that?

            • Normally, after the I140 is approved, how long does USCIS take to adjudicate your I485 application (filed concurrently and I140 approved)? Of course, it depends on service center work loads but asking this question just to get an idea on a time frame in case anyone has dug into that matter.

              • My I-140 was approved in September 2020. I-485 was filed in Phoenix in February 2021 and transferred to Nebraska in April 2021...still waiting...been over a year now...and my case hasn't changed status for 237 days

                02/02/21 - Day 1 - Delivered - signed by F.Brown
                04/02/21 - Day 60 - NOA Received for I-485, I-131, I-765

                06/29/21 - Day 147 - Fingerprints Taken
                10/01/21 - Day 242 - EAD/AP Combo Card in hand
                07/07/22 - Day 521 - Transfer to Missouri
                07/13/22 - Day 527 - RFE for new I-693
                08/03/22 - Day 548 - New I-693 sent
                08/22/22 - Day 567 - New Card is being produced!!!!

                  I didn't submit my 693 at the time of filing my AOS. I didn't get a courtesy letter yet. My I140 is not approved so I guess it would have to be approved before they would send me the courtesy letter for 693.

                      I wish it happens like you say but if they send a RFE for medicals, it will be against the 485 so it's highly likely but I just wish your word comes true and it turns out to be something like that!

                        Not sure if the I-140 for those was approved or not at the time they got the RFE for 693.

                          Ok. Thanks. As the RFE here is for the I140, it can't be for 693. Hopefully my 485 would be immediately considered for processing as soon as my 140 gets approved. Fingers crossed. I really wish that my 485 gets approved before October. Seems highly unlikely but just hoping.

                              Is it for getting a response on your I140? If yes, I'd say, don't follow up. In retrospect, I'm thinking may be I should not have raised a service request and I might not have got a RFE.

                                Ah, okay. But SR may not have anything to do with RFE. I know 2 people who raised SR and got their application approved without RFE. So, it sheer seems to be luck or timing.
