  • I130 NOID Help!

    I just received an NOID for my I130 today. My situation is that I was an F1 student and then got adopted. My adopted father then filed the for form for me. The reasons listed in the NOID include:
    1. Insufficient evidence of joint residence
    2. Failed to prove that the adoption does not fall into Hague Convention
    3. Adoption for Immigration Purpose
    Based on my situation, what is my chance to overcome the NOID?

    First off how old are you? As far as I know if you are over 16 or 28 you can not be adopted. also USCIS have specific details regarding adoption and policies you want to make sure you meet all of them

      Your situation sounds complex and a NOID is a serious matter. You should get some help from a good immigration lawyer who has handled similar cases before.

      10/14/20 - I-765 and I-131 approved
      10/19/20 - EAD/AP issued
      12/01/21 - EAD/AP renewed

        I was under 16 when I was adopted. I don't think there is anything wrong with my adoption process, but the USCIS seems to think the adoption is not bona fide. How can I prove that the adoption is legit?

          I have already scheduled a meeting with my lawyer, but I would like to know what to expect for this case beforehand. Is there anything I could do to overcome an NOID?

            A Lot of times things are simpler than we think. I am not an attorney but your number 1 says you did not provide enough evidence for residential address, so may be that is why the thing is for immigration purposes therefore may be all the want is just a little bit more evidence.
