  • Form I-485 Basic Questions

    I have some basic questions about Form I-485, but first, can someone tell me what is considered posting too much?
    I have various questions about various forms, and our situation in general, but I'm not sure how many different posts are okay to make in a day.

    Note: When answering these questions, please also include how you know your answer is correct or where I can see the answer clearly explained by an official source.
    I'm worried about USCIS rejecting his application over small mistakes, or the process being delayed.

    Questions:
    1.) "U.S. Mailing Address, In Care Of Name"

    (Example: Form I-485 Page 2 Part 1 Item 13.a)
    Where it says "In Care Of", is it okay to write 2 first names, being as the husband and wife both live in the house?
    For instance, "Mary and John Smith".
    Or must it be only one name? ("Mary Smith") And in that case, does it matter which one?

    2.) Form I-485 Page 2 Part 1 Item 16
    (and Form I-130 Page 7 Part 4 Item 48 and Form I-765 Page 3 Part 2 Item 21.c)
    It asks for the Travel Document Number.
    Above that, it asks for the Passport Number.
    Should he write "N/A" under Travel Document Number, or write the Passport Number again, followed by the word "passport" in parentheses () to be clear?

    3.) Form I-485 Page 2 Part 1 Item 19 -
    "Nonimmigrant Visa Number from this Passport (if any)"
    He came on an ESTA, so this does not apply to him and he can just write "N/A", correct?

    4.) Form I-485 Page 2 Part 1 Item 22.a -
    "When I last arrived in the United States, I: Was inspected at a port of entry and admitted as (for example, exchange visitor, visitor, waived through; temporary worker; student)"
    Is it correct in his case to write "WT (waiver-tourist)"?
    Again, he came on an ESTA, and "WT" is stamped in his passport, and is also his class of admission on Form I-94.

    5.) Form I-485 Page 2 Part 1 Item 23.a -
    "If you were issued a Form I-94 Arrival-Departure Record Number:"
    He was not given any form or something of the sort at the airport.
    This means he is supposed to access Form I-94 online and use the information from there, correct?
    (We already did that, but I'm not sure if this question is intended for him since he wasn't actually given a paper.)

    6.) Form I-485 Page 3 Part 1 Item 2 -
    "Are you applying for adjustment based on the Immigration and Nationality Act (INA) section 245(i)?"

    This question is only about people who were the beneficiary of a petition filed before 2001, correct?

    7.) Form I-485 Page 4 Part 2 Item 3 -
    "If you are the principal applicant, provide the following information.
    Receipt Number of Underlying Petition (if any)"
    Is he still called the principal applicant, despite being the only applicant?
    We are married (I am a US citizen) and we are filing forms I-130 and I-485 concurrently, so he does not have an underlying petition, right?
    It's correct to write "N/A"?

    Or must it be only one name? ("Mary Smith") And in that case, does it matter which one? DON'T COMPLICATE THINGS JUST PUT ONE NAME. WHAT IS THE REASON YOU WANT TWO NAMES ANYWAY?

    (and Form I-130 Page 7 Part 4 Item 48 and Form I-765 Page 3 Part 2 Item 21.c)
    It asks for the Travel Document Number.

    Should he write "N/A" under Travel Document Number, or write the Passport Number again, followed by the word "passport" in parentheses () to be clear? I JUST PUT MY PASSPORT NUMBER WITHOUT ANY WORDING AND AS FAR AS I KNOW MINE IS NOT REJECTED AS I RECEIVED MY RECEIPT NUMBERS ALREADY.

    3.) Form I-485 Page 2 Part 1 Item 19 -

    He came on an ESTA, so this does not apply to him and he can just write "N/A", correct? I THINK SO

    4.) Form I-485 Page 2 Part 1 Item 22.a -

    Is it correct in his case to write "WT (waiver-tourist)"?
    Again, he came on an ESTA, and "WT" is stamped in his passport, and is also his class of admission on Form I-94. ESTA WILL BE THE CORRECT

      My answers are:
      1) usually people don't put anything there so all mail from USCIS is directed to the applicant (your spouse in this case).
      2) if he entered with a passport then the passport questions should be filled and not the travel document. If the instructions say put "N/A" then use that.
      3) he has no visa number, "N/A" is correct
      4) tourist or waiver tourist
      5) all people arriving by plane or boat to the USA are issued an electronic I94 that can be accessed online.
      6) no (he will not apply under INA)
      7) principal applicant = main applicant = only applicant.

      I think there is a lot of information (and answers) on the form instructions, for example, this information related to your question #5:
      NOTE: If you were admitted to the United States by CBP at an airport or seaport after April 30, 2013, you may have been issued an electronic Form I-94 by CBP, instead of a paper Form I-94. You may visit the CBP website at www.cbp.gov/i94 to obtain a paper version of an electronic Form I-94.
