    Hi,
    According to the VISA Bullentin, my number is now current. Should I go ahead and file for AOS now? Or Do I still wait till Oct 2010? I ask because my H1B expires Sept. 12th and I am very worried about it. I noticed the last time I filed my papers(May 10), I received recipt notice about 2 weeks, and was scheduled for finger printing a month out(June 15) and I-485 two months(July 15) out....so it appears I will fall into the required fiscal year if I file early Sept.

    You can file I-485 only October 1st, no earlier. Your number will become current only October 1st

      Hi,
      I received a letter from KCC the other day telling me that I can apply for AOS Oct 1st. However my number which is in the 10000s haven't come up in the Bulletin yet.
      Do I need to wait until my number comes up or should I apply on Oct 1st?

        I just called the NCSC today but they couldn't answer my question. Does anyone know whether or not I'm eligible to apply for AOS on Oct 1 or do I need to wait for my Case number to become active?

          See my answer in another thread (I got from KCC):

          If you are in the United States, you may be eligible to apply to the Citizenship and Immigration Services (CIS) for adjustment of status. The option to adjust status may no longer be available to all applicants. To determine whether you are eligible to adjust your status you MUST contact the CIS. Once the CIS confirms your eligibility to adjust status they will provide you with the additional information that you need. When contacting your local CIS office they may inform you that you will not be eligible to file your adjustment until your case number is current and available for processing.

            selfemployedonIvisa, I think you should schedule an appointment at your local USCIS office, and ask them this question. I know the information we get could be confusing...like what happened to me. However, I will suggest you try to get them to write it down on a paper, or get the name of the person giving you the information(in case you need to reference it). If you are still in status and will be in status until your number is ready, I suggest you wait till then.
