EB1C current : is it concurrent filing or concurrent processing?

  • EB1C current : is it concurrent filing or concurrent processing?


    We have submitted EB1C I140+ I485 docs (along with EAD and AP docs and medical reports)
    Doubt is :
    Will all I140 and I485 adjudicated together ( texas center shows 24 months max----So both in 24 months + or -ve couple of days??)
    Or only filing is concurrent processing is individual ?Meaning only I140 will be processed in max 24 months.i485 will be done in 50 months ( as per current processing timelines)

    Is only filing (sending I-140 and I-485 together). There are some categories that can't do that and they need to send I-360 first and until that is approved then send I-485.

    If your I-140 is not approved within the dates shown, then you can do an inquiry. You can't do an inquiry for I-485 until is over the expected times shown.

    Date range change from time to time. I have seen it max 35, then 50, then back, and again.

    I hope in a year the estimates go down to "normal". Changes like 2 years for EAD will help reduce the workload. Right now people with EAD of 1 year are starting the renewal process 6 months before expiration (they are talking around 11 months, even for renewals that have only a 180-day extension). With 2 year EADs, many people will not need to renew, and others will wait 1.5+ years to start the renewal process. Good luck.

      "When adjudicating concurrent filings, we determine the eligibility for the immigrant visa petition first. If a visa number remains available for the immigrant classification and your Form I-485 is approvable (which in certain cases requires an interview), we will generally consider the adjustment application at the same time. We will mail separate decision notices for both forms."


      Any one has experience in the past, that I140 and I 485 were approved back to back?

        I have the same question as yours but haven't found an answer. Do share if you find anything. In my case the I140 was filed in Nebraska service center and the AOS along with EAD & AP were filed with National Benefits Center. USCIS then transferred my AOS application to Nebraska service center where my I140 is which leads me to think that they would be processed together but there hasn't been no change in status since the case was transferred more than a month back.

        Movement currently seems very slow because they were a lot of applications in Oct. So while they're continuing to process the application, it seems like it's not moving because still the cases in Oct are being processed. I'm assuming that once the Oct applications are processed, it should move quickly as there might not have been a lot of EB applications after Oct'20.
