  • Uscis returned medical exam opened but gave receipt for i-485

    I have filed for i-485, i-131 and i765. USCIS accepted i-485 & i-765 send giving valid receipt notices but rejected i-131 saying invalid fees by sending rejection notice. But when AP applications are filed with I-485 AOS applications, separate filing fees are NOT required for AP (or EAD). so not sure, why they rejected.

    oddly, USCIS also returned the AOS supporting documents (birth certificates, passport copies, bona fide marriage docs, etc.) including their opened medical exams and all the passport-type photos.



    1. If anyone seen this before?
    2. I am worried to medical exams as they costs me a lot of money without any insurance.
    3. Should I wait for RFE or we should send the Documents back pointing out their mistake? As per my lawyer, we will have to wait for RFE for i485 before sending medical exams & other documents back. But I wanted to see if anyone has faced this situation before.

    2. Sorry this happened to you. You will need to work with the civil surgeon, I hope they can give you another sealed envelope for free or at a reduced cost. You may need a newer date if they end up rejecting the I-485 too.
    3. If they sent back the AOS supporting documents they made a mistake just rejecting I-131 and they in fact are rejecting the AOS.

    I think they messed up your case and who knows what will happen, maybe RFE to send the supporting documents again, maybe they will reject I-485 after further review. They don't advise sending documents without RFE. Usually, they reject the whole AOS package when they say "invalid fees" and not just one form, don't understand how they can reject just I-131 and return all supporting documents for AOS.

      That's the twist. I-485 is accepted,. I know this for sure as they cashed the check & sent a receipt for I-485. But weird part which I cannot digest is they sent back the supporting documents for 485 along with rejection for I-131. Just I-131 I have to refile. Seems now we wait for RFE which could take months. AFAIK, medical tests are valid for 30days only. so after that I have to do the labs again

      is there a way, where we can tell USCIS about their mistake and they can accept the documents earlier? It would about $1000 for medical exam fees to be paid extra out of pocket.

        Medical exams are valid for 2 years but several officers think they are only valid for 60 days from the doctor's signature and when they receive the sealed envelope.

        Have you talked with the civil surgeon? I hope they can offer a discount. $1000 is for 1 person or more? You can try looking at other places to do the physical in the future if the doctor doesn't give you a discount.

        To apply again for I-131 you need a copy of the I-485 receipt and no payment.

        It is very strange that they sent the I-485 receipt and return the supporting documents. I hope not but maybe they will deny your I-485 saying that you didn't attach the required documents. Good luck.
