    Hi everyone

    is receiving of the Supplemental Nutrition Assistance Program (SNAP) benefits by the US citizen considered as the Public charge or not.

    will taking the SNAP benefits by the US citizen spouse will negatively effect the AOS case for the other spouse.

    I don’t think that matters , i944 is no longer required for AOS package submission.

      But in US citizen spouse is not working and the other spouse is working the benefits we will get will be based on the non US citizen income. will that effect is any way, the AOS process

        Yes it is a Public Charge. As SNAP benefits issued to a household and everyone's income is the base for determination the size of amount you receive.

          Here is the latest from the USCIS site regarding vacating the Public Charge requirement:

          On Nov. 2, 2020, the U.S. District Court for the Northern District of Illinois vacated the Inadmissibility on Public Charge Grounds final rule, 84 Fed. Reg. 41,292 (Aug. 14, 2019), as amended by Inadmissibility on Public Charge Grounds; Correction, 84 Fed. Reg. 52,357 (Oct. 2, 2019) (“Public Charge Final Rule”) nationwide.

              No. First, only benefits received by the person themself will be considered in their public charge determination. Second, non-cash benefits like SNAP are not considered in the public charge determination, so even if the immigrant themself used SNAP, it would not affect their public charge determination.
