  • Dependent's GC approval before Primary applicant

    My, my wife and son for RFEs same day. My attorney did not send my documents yet for RFE coz she is still working on 485J. I sent my wife and son's RFE and they are delivered Monday (7/19). This morning I got alert that my son's case that his is in Review. Will they approve my son's GC without approving mine?

    I don't think so. I have never read a dependent GC approved before the principal, only that the principal is approved and the dependents can be approved the same day or weeks later. I hope you get all your GCs soon.

    Our cases are stuck in "Response to USCIS' request for evidence was received".

    Your son's case says "In Review" or another thing?

        I'm in the same situation, we are family of five. In February 2021 we received RFE (medical reports) for all. In March 2021 Two Green Cards for our minor kids were approved and delivered to us. Rest of three (Me,My spouse and adult son) still showing case status "Response to USCIS" request for evidence was received". I'm the principal applicant and case is in Texas from February 2020 .

          Thank you Lucky_ for your post, I didn't know it was possible to get GC for dependents before the principal.

          We also received RFE (medical reports) for all in February 2021. All 18 years old and over. Our case in Texas. Status: response to USCIS received.

            My son is younger that 18.

            I have another question.

            In 2012 company attorney filed 485 for all 3 of us (me, wife and son). Since then attorney got changed and company changed policy not to file for dependents. I submitted RFER for my wife and son last week and selected "No" for G28. Would this be a problem?

              I don't think that will be a problem. I guess USCIS will just stop sending documents to the attorney related to your dependents.
